Shortly before the 2016 election, The Journal reported that an FBI investigation was underway involving then-candidate Hillary Clinton and the Clinton Foundation. McCabe in May 2017 denied that he was the source of the leak — but later fessed up, angering bureau investigators who had been spinning their wheels trying to identify the source of the leak.
The documents, which the FBI released in response to a Freedom of Information Act lawsuit by the government watchdog group Citizens for Responsibility and Ethics in Washington, include transcripts of McCabe’s conversations with investigators, who were frustrated after wasting their time on the probe.
On Aug. 18, 2017, FBI officials grilled McCabe again to try to unravel what they said was “conflicting information” they had gathered about the possible leak to the Journal, The Daily Beast reported.
“I need to know from you, did you authorize this article? Were you aware of it? Did you authorize it?” an agent asked McCabe, The agent then described his response: “And as nice as could be, he said, ‘Yep. Yep I did.’”
The investigator then said that “things had suddenly changed 180 degrees with this” after McCabe’s admission, which turned his initial denials into a potential crime.
Lying to the FBI is a crime; that is what General Michael Flynn was charged with and pled guilty to, although the evidence suggests that he may well have been innocent. As to Andrew McCabe, there is no ambiguity: by his own admission, he is guilty. It should be emphasized that this leak by McCabe involved the FBI’s investigation of Hillary Clinton. It had nothing to do with the much more important FBI effort to swing the election to Hillary, or, failing that, to implement an “insurance policy” that would rid the republic of Donald Trump. It was in “Andy’s office” that Peter Strozk and others discussed that infamous alternative, which, as we now know, was implemented. As far as I know, McCabe’s role in the FBI’s attempt to destroy Donald Trump is not yet clear.

In a remarkable act of hubris, in late 2018 Andrew McCabe sued the DOJ for wrongful termination through Lawfare lawyer Michael Bromwich. The legal argument was/is essentially that McCabe was allowed to lie to FBI investigators because he was the head of the FBI (an employee of the agency).
In response to the McCabe lawsuit the DOJ filed a motion for summary dismissal due to McCabe’s lying, and an Office of Professional Responsibility (OPR) affirmation, saying the termination was valid.
In today’s response motion opposing the summary judgement [cloud pdf here], using a new batch of lawyers, McCabe’s legal team argues President Trump called McCabe a “dirty cop” last month, and that proves McCabe’s firing in March 2018 was wrongful.
Yes, that is their argument.

It claims it pays these "journalists" for " " " " " research " " " " " but I suspect the money is really being paid to get these "journalists" to write up Fusion's fictions in the press.
It may not be an explicit quid pro quo transaction. It may be more like: The reporter wants to do favors for Fusion GPS because every three months Fusion pays them for a very easy make-work " " " " research " " " " job, and so when Fusion asks them to plant one of their conspiracy theory fictions, they naturally want to please the guy giving them money.
Giving them money, ostensibly for other reasons.
But come on -- when you're on the take, you're on the take.

For a simple example, suppose that Barr approved prosecution all the way up to former attorney general Loretta Lynch. Based upon that precedent, what would stop a future attorney general from pursuing a political prosecution of the retired William Barr down the road? Care must be taken to avoid the precedent of high-level political war. Ultimately, justice needs to be done, so a compromise must be made. The most prudent course would be to prosecute up to a high enough level that sends a clear message to the subordinates of future leaders: follow corrupt orders at your own peril. This is likely the best way to disarm and deter the next corrupt administration without creating a constitutional crisis. The likes of Comey, McCabe, Rosenstein, Power, and so on understand this. There's no doubt they are living in fear and uncertainty. Law-abiding Americans should take minor solace in the notion that they are suffering with fear right now as a result of their crimes.
The next question is timing. Suppose Comey gets indicted in spring 2020. CNN, MSNBC, and the rest of the corrupt mainstream media would start a 24-7 propaganda campaign that would look a lot like the Russia collusion narrative. However, this time, it would be louder and more desperate, and it would center on how a corrupt Donald Trump has weaponized the DOJ to go after his political enemies. The fact that Democrats and the MSM have already accused Trump of using the "awesome powers of government to punish political enemies" highlights an unmistakable Alinsky-esque pattern that has become prominent since 2016, which is — whatever you are guilty of, blame it on the other side.

Is this correlation with impeachment, or true causation? Some of this enthusiasm could be an organic result of watching the Democratic presidential field pull a hard left to get to the presidential nomination. The presidential debates keep stoking progressive passions, but are starting to also show some stepping back from hardline goals. Despite everyone initially paying some lip service to Medicare for All, Bernie Sanders is now the only candidate fully committed to it. The Green New Deal talk has gotten quieter, too, although Elizabeth Warren did start mentioning a “Blue New Deal” for the oceans without much elaboration.Da Beast, Graham: Rudy Should Scrub Evidence for Russian Propaganda . Why? The Democrats actually bought and paid for it. I think Rudy does have the goods on Slow Joe, if not legally, at least ethically. But will our media present that information accurately?

Even assuming this is just correlation and not causation, it’s very bad news for Democrats. Their impeachment project was doomed to failure in terms of removing Trump in a GOP-majority Senate unless one of two things happened. Either public opinion would have to dramatically shift in favor of removal, or Trump’s political support among his base would have to collapse, preferably both. Trump’s donor figures suggest that his base is stronger than ever at precisely the same time Democrats are trying this strategy.
