Election 2020: DOJ Stuck in a Bind on Jan. 6 Persecutions

'Shipwreckedcrew', writing at Human Events has a long article on how The Biden Justice Department Can’t Seem To Produce the Evidence It Supposedly Used To Indict the January 6th Protest Cases. "Offering pleas to misdemeanors and dismissing felonies violates written DOJ policies." It seems the problem is the 14,000 hours of video they have (as well as mountains of cell phone and social media evidence), and can't wade through to find any exculpatory evidence. If they can't respond to discovery, they can't prosecute. And they already have a lot of people in holding longer than they would be sentenced on the misdemeanors.

What is obvious now in hindsight is that the Biden Justice Department prosecutors sought and obtained felony charges in many cases based on almost no meaningful review of actual evidence about what happened; it used fear and hysteria to justify doing so. Now they are being pressed to provide the evidence that is supposed to support the felony charges they brought, and are unable to do so in the timeframe required by law. So they are abandoning the cases on the best possible outcome available—the least serious of all federal crimes, “petty” misdemeanors.

Now that the DOJ has gone down the path of exchanging guilty pleas to misdemeanors for some defendants charged with felonies, it will become more difficult to not do the same for a much larger number of defendants where the facts are substantially the same.

JTN has a couple of posts on the problems with spoiled ballots and adjudication in Georgia, Georgia ballots rejected by machines were later altered by election workers to count, "Records obtained by Just the News provide unprecedented glimpse into human adjudication of thousands of ballots, where marks for candidates like Trump were sometimes removed so ballots could count for Biden," and See disputed Georgia ballots where election workers decided a vote was for Biden, not Trump, "State policy appears to allow subjective worker judgment in divining voter intent where vote is unclear."

At least eight GOP-controlled states have passed bans on donations to election offices this year as Republicans try to block outside funding of voting operations. The legislation often comes as part of Republican packages that also put new limits on how voters can cast ballots and impose new requirements on county or city-based election officials.

The NYT, cited at Hot Hair whines about  Former acting AG testifies about Trump's attempt to subvert election, by actually talking to a DOJ employee; imagine that. But as Insty points shouts out, YOU KNOW WHO GETS TO AUTHORIZE CONVERSATIONS WITH THE PRESIDENT? THE PRESIDENT.

It’s also rich to see the DOJ acting concerned about people casting doubt on an election, when it ran a dishonest, partisan, and almost certainly illegal operation — “Crossfire Hurricane” — to do just that.

Though to be fair, I’m sure they keep a pretty tight lid on who gets to talk to Biden.

Obviously the political machinery, media and big tech are intent on removing anything that challenges the results of the 2020 election regardless of how much evidence exists to point out the manipulation. However, once you see the strings on the marionettes it is impossible to return to that place before when you did not see them.

At Am Great, The 2020 Election is Breaking the Legal Profession "Sanctioning lawyers who are fighting to uphold the country’s election process is a great way to scare away competent, qualified, and strong ones from taking charged cases." Soon to be expanded into other areas. 

The Hill reports that a Colorado federal magistrate judge, N. Reid Neureiter, “sanctioned lawyers who challenged the 2020 presidential election results, calling their election claims ‘fantastical.’” “Plaintiffs’ counsel shall jointly and severally pay the moving Defendants’ reasonable attorneys [fees]”—which is very likely to be many thousands of dollars. This ruling comes while a federal district judge in Michigan, Linda Parker, considers imposing sanctions on attorneys Sidney Powell and Lin Wood, both of whom raised questions about the propriety of the 2020 presidential election.

In January, James Boasberg, a federal district judge in Washington, D.C., “referred a Minnesota lawyer [Erick Kardaal] for potential discipline” for his lawsuit regarding the last election. And these three proceedings occur in the shadow of the sanctioning of Rudy Giuliani by a New York state appellate court, which saw fit to suspend his law license for representing his client, then-President Donald J. Trump, in the wake of the 2020 election. Giuliani likely will face “permanent sanctions” at the conclusion of the process.

These are deeply troubling developments. Even the Bush v. Gore saga didn’t generate such official acrimony. . .

The Democrats need to keep hitting the COVID panic button for a couple of reasons. The first is that they’ve gone kinda fascist now and want to keep the masses in check with the “public health” tyranny. The other reason is that they want to use all of this to keep flushing election laws down the toilet. That makes me wonder if maybe they aren’t peaking a little too soon here. They might want to pace themselves with the variant panic if they want to be able to jerk around the election laws 15 months from now.

Then again, the way Fauci and Co. have been just making stuff up, they may not be worried about their ability to wing it for a few more years.
