Did The Trump Team Stick it to DOJ? Progress on 'Special Master'

I always have a hard time getting these started again after taking a day off; too much material accumulates, and I just have to make choices as to what to include and what to leave behind. Still worth it.

The latest motion filed by Trump’s legal team seeks to further block the Justice Department from reviewing the documents. It also brought the heat in their 21-page filing that torched the legal justification for the FBI’s raid and the seizure of documents from the property (via The Guardian):
Lawyers for Donald Trump asked a federal judge on Monday to deny the justice department’s request to regain access to some documents the FBI seized from the former president’s Mar-a-Lago resort and restart the criminal investigation into his unauthorized retention of government documents.

The response from the Trump legal team reiterated that it wanted a so-called special master to review all of the seized materials, asking the judge to uphold her earlier order barring prosecutors from using the documents in a criminal investigation until the process was complete.

But in the 21-page filing, Trump’s lawyers interpreted the Presidential Records Act in sometimes unusual ways, and accused the justice department of criminalizing what they considered a dispute between Trump and the National Archives about how documents should be handled.

“In what at its core is a document storage dispute that has spiraled out of control,” the response from the Trump legal team said, “the government wrongfully seeks to criminalize the possession by the 45th president of his own presidential and personal records.”
Mike Davis, a former law clerk for Justice Neil Gorsuch, whose legal analysis we’ve featured prominently here, added that this filing “puts the dagger through the heart of the Biden DOJ's bogus, political charade.”

Regarding the 'special master' that Judge Cannon is requesting, Da Caller reports Biden DOJ Pushes For Judge To Appoint Dem Donor As Special Master. It appears that the Trump team has objections to both candidates for the position proposed by the DOJ, but CNN reports Justice Department open to one of Trump's proposed candidates for special master review 

Dearie, originally a nominee of former President Ronald Reagan, has served as a federal judge in New York since the 1980s. He retired in 2011 and is now a senior judge on the circuit. 

Dearie also served a seven-year term on the US Foreign Intelligence Surveillance Court, or FISA court. He was one of the judges who approved an FBI and DOJ request to surveil Carter Page, a Trump campaign foreign policy adviser, as part of the federal inquiry into whether Russia interfered in the 2016 election.

And he might be kind of pissed at the shenanigans the DOJ and FBI used to obtain to those warrants.

Not shockingly, Sundance has A Different Take on the Dismissal of the Trump v Clinton Lawsuit. "If the documents seized by the FBI were part of the lawsuit established by President Trump and his legal team via Trump -v- Clinton, then the material seized is all attorney client work product.  Lawfully obtained, constitutionally declassified and legally protected material. This is where the ‘special master’ will play a key role."

Based on the Politico reporter's advanced knowledge, Dhillon speculated that the FBI "is telling reporters about these search warrants and subpoenas before they’re executed."

"There’s no other explanation for this," she said. "And I think the reason for this is to instill fear into Donald Trump’s supporters and into those who would challenge election irregularities right before an upcoming election."

"[I]t is illegal for the DOJ to leak this information to the media," Dhillon also said.

So, here's my big (for me) announcement: I am retiring from the active practice of law in the courts. I will no longer be representing clients in litigation (criminal, civil, appeal, administrative) matters or defending investigations. I am done being a working litigator.

What I am not doing is "retiring" from public life. I am not closing my litigation practice to "spend more time with my family." No. I am done being an in-court lawyer because:

I'll have more to say later, but the bottom line is, after 26 years, & especially the last few, I have come to an inescapable conclusion: there is no justice to be had in our "justice" system. I am no longer willing to participate in a system that I consider to be a total farce.

My status as a practicing litigator has constrained me from speaking truth to and about the system. With that constraint removed, I will not be silent any longer.

The state of our institutions - particularly the criminal "justice" ones, but also the federal civil courts - is dire, & is unacceptable for a functioning republic. They must be radically overhauled & reformed, & a renewed emphasis on first principles restored.
