In the greatest non-surprise of the year, a Washington D.C. area jury, in a town that's about 95% Democrat, decided that it's OK for a Russian national to lie to the FBI, if FBI really wants to hear the lies support the surveillance of their political opponents. Of course they acquitted Danchenko, just as a DC jury acquitted Hillary Clinton's lawyer Michael Sussman who lied when he brought a Russiagate allegation to the FBI, the one about the Russian bank Alfa secretly communicating with Trump's servers (it was always a lie), and then lied about representing the Hillary Clinton campaign. He lied and said he was just a Concerned Citizen Acting Independently for the Public Weal.

Igor Danchenko was a well-known fabricator of (dis)information long before the FBI made the purposeful decision to enlist him in their Trump targeting efforts. Specifically because Danchenko had no moral compass to the truth he was particularly useful for the FBI effort. This was the big problem for John Durham in prosecuting Danchenko for material lies the FBI knew from the outset were false.

How does the same DOJ who used the lies for their political purposes, then prosecute the liar for the false information? That was always the structural flaw in any case brought by Durham. As a result, the trial was not so much about the lying Danchenko as it was about the lying FBI and their use of Danchenko.

I really don't see that as an obstacle to a just decision. Sure, Danchenko lied to the FBI, and the FBI knew they were lies, either from the start or almost immediately, but the FBI desperately needed those lies to help maintain the surveillance of the Trump campaign and administration. Therefore the lies were material in that they enabled the continued actions against Trump. It doesn't mean Danchenko is off the hook, it means the FBI is complicit. The problem, as I see it, is that all trials of a national political nature are conducted in the shadows of the Washington monument, where the jury pool is inherently stacked in such a way that Democrats can almost literally get away with murder, while Republicans can be convicted of non-crimes. We see this in the Jan. 6 trials as well. Honestly, I don't know why Kevin Clinesmith pled guilty instead of taking his chances with a DC jury. Until we deal with this issue, it is pretty clear that for nations issues we have a deeply flawed system of justice. But don't worry, John Durham is going to write a report that absolutely excoriates the Clinton camp and the FBI!
