Flotsam and Jetsam - Supes Rule Prez can Fire Any Agency Head Except Fed

A number of case came down from on high at the Supreme Court yesterday, and it was a mixed bag for the President (as it usually is). The court ruled in Trump v. Slaughter and Trump v Wilcox that the President was free to fire the head of any executive agency, including those the Congress attempted to designate as "independent", but quickly tempered that by ruling in Trump v Cook that Trump could not fire Janet Cook from the Federal Reserve board without some kind of due process. Weird, but as my Daddy used say, consistency is the hobgoblin of little minds. In Watson v. RNC they also ruled that states could count mail-in ballot that arrived after election day, as long as they were postmarked by election day. Althouse spent the day Waiting on the Supreme Court. I didn't. Capt. Ed at Hat Hair VIP, SCOTUS Slaughters Humphrey's Executor – But the Fed ... Oilfield Rando @Oilfield_Rando, "In a stunning blow to Our Democracy™, SCOTUS has ruled that unelected bureaucrats can’t do whatever they want and run federal agencies like their personal fiefdoms in perpetuity," Quote Benjamin Ryan @benryanwriter, "NEWS: Supreme Court overrules a 90-year-old precedent and frees the president to fire independent agency heads The Supreme Court ruled today that President Trump can remove Federal Trade Commission members at will, and in doing so it overruled Humphrey's Executor, the 1935 decision that has protected independent agencies for nine decades. The case is Trump v. Slaughter, and it reshapes the federal bureaucracy..." Sundance at CTH, Supreme Court Rules 6-3 That President Can Remove Any Agency Head in Executive Branch. Flotsam and Jetsam - Super! Tuesday Fallout

Yesterday was Super! Tuesday, and numerous states held their primaries. Of course, there's lots of numbers, but what you really need to know is that Trump swept the Republican primaries, except for Vermont, where Nikki Haley squeaked out a bare majority. In the Democrat primaries, where there is, of course, Biden dominated, with a smattering of non-committed votes, and votes for the usual loons. The main story there is that in California baseball great Steve Garvey got enough votes to displace Katie Porter in the "jungle primary" for Diane Feinstein's seat, leaving him Adam Schiff's opponent in November. Sadly, Schiff is probably going to win, short of a godly intervention.

But if you want to explore the gory details, the guys at Hat Hair have divided up the work, John Sexton with Super Tuesday: Pacific/Mountain Primary Live Results, Dave Strom with Live Blog: Important House and Senate Races, Capt. Ed with Live Results: Super Tuesday's CT Primaries From Deep In the Heart O' Texas (Update), and Jazz Shaw, Super Tuesday: ET Races, Alabama and North Carolina State Govt Primaries; UPDATE: Haley Wins Vermont. Regarding the interesting case in California, Stacy McCain asks California Democrats Why Do They Hate Women and Black People So Much? after they pushed out Barbara Lee and Katie Porter in favor of Adam Schiff. Althouse, It's Super Tuesday, and the only interesting thing seems to be whether the California Senate race will be between Adam Schiff and Katie Porter or Adam Schiff and Steve Garvey. "I'm reading "Schiff’s insider support trumps Porter’s outsider appeal/Polling shows Rep. Before the appearance with the magistrate, because the FBI had “arrested” Steve, the U.S. Marshal’s Office and courthouse security added a belly chain, box cuffs, and leg shackles. That involves a chain around the waist, with handcuffs in the front attached to the chain so the defendant can’t move his arms up and down or side to side. Another chain goes from the belly chain down to a chain attaching two ankle cuffs to each other. Shackled that way means all a defendant can do is shuffle his feet with security officers usually on both sides.

Ten minutes after the hearing ended, Steve walked out of the courthouse through the front doors like anyone else. He could have — and should have — walked into the courthouse the same way. Nothing justifies what Department of Justice put Steve Baker through on March 1. All for a journalist who spent 37 minutes inside the Capitol recording the events of January 6 as they unfolded.

The criminal complaint is dated February 21, 2024. It took 1,141 days for the Department of Justice to decide that a journalist covering an international news event was a legitimate target of a federal criminal prosecution.

The Justice Department had been threatening to take this step for more than two and a half years, ever since the FBI first contacted Steve and asked for him to sit for an interview in North Carolina. Eventually Steve did sit for that interview, answering their questions about his recollections of the day and his actions. Later he handed over all the video he had taken to the FBI and federal prosecutors.

It seems noteworthy that the Justice Department finally felt the need to take this step just weeks after Steve broke stories for Blaze Media about members of the U.S. Capitol Police who likely committed perjury during one or more January 6 trials. Steve also happens to be one of a very small number of journalists working closely with multiple House committees studying video evidence of the events of January 6 that has not yet been made public.

Our defense will make plain for the entire country to see that there were dozens of journalists — some working for media companies and others who were freelancers like Steve was at the time — who both were present on “restricted grounds” and went inside the Capitol in the same manner that has resulted in hundreds of protesters being prosecuted — through broken windows and doors. One in particular, a freelancer, had his lengthy story published in the New Yorker only nine days after and was later promoted for a Pulitzer Prize. He’s never been charged.

This has all the earmarks of “selective prosecution.” The government — foolishly in my view — noted in the affidavit in support of the criminal complaint that Steve made comments after January 6 that endorsed or supported the actions of protesters on that day.

That is political speech and has always been political speech, and the inclusion of that information gives away the game regarding the government’s motives in singling out Steve among the dozens of journalists who could be charged but have not been.

Flotsam and Jetsam on Super! Tuesday

Of course, today is filled with reports of and reactions to yesterday's Supreme Court ruling squashing the various blue states attempts to keep Donald Trump off the ballot using the 14 Amendments insurrection clause. Insty, THIS IS CORRECT, OF COURSE: "Smackdown on CO: Unanimous SCOTUS Rules States Cannot DQ Trump on 14A; RNC: ‘Pure Election Interference.’ A lot of lefty law professors — and some conservatives who succumbed to TDS — managed to fool themselves otherwise, but this was always a dumb argument"  and on Substack, The Supreme Court Rules "Many pundits are fools."Spencer Brown at TownHall, SCOTUS Rules Unanimously on Trump Ballot Case. Jacob Sullum at Reason, Supreme Court Unanimously Rules That States May Not Disqualify Trump As an Insurrectionist. "Three justices who concurred in that judgment accuse the majority of trying to "insulate all alleged insurrectionists from future challenges" by going further than necessary." Althouse, The Supreme Court case.... is unanimous and in Trump's favor. "Here's the full text." Roger Kimball at Spec World, Supreme Court rejects Colorado’s attempt to kick Trump off ballot "The 9-0 unanimous verdict is cheery news for partisans of genuine democracy." Cutie Pavlich at TownHall, Justice Barrett Explains the Message Americans Should Take Away From the Trump Ballot Ruling ""In my judgment, this is not the time to amplify disagreement with stridency. The Court has settled a politically charged issue in the volatile season of a Presidential election. Particularly in this circumstance, writings on the Court should turn the national temperature down, not up," Barrett wrote. "For present purposes, our differences are far less important than our unanimity: All nine Justices agree on the outcome of this case. That is the message Americans should take home." A surprisingly sharp take on it from Ace, in italics with the trademark flaming skull, Supreme Court Unanimously Strikes Down the Colorado Supreme Court's Juvenile Internet Trolling Disguised as a "Judicial Decision"

Six Justices -- the five "conservatives," plus Roberts -- voted for an opinion stating that Congress alone has the power to announce who is disabled from holding federal office due to "insurrectionary" acts. Presumably Congress would actually pass a law stating that certain persons named in the law were insurrectionists and not eligible to hold federal office.

The three liberal Justices claimed that that goes to far, and that a state could rule that Trump (or any other office-seeker) was barred from seeking federal office if that person had been convicted under the federal law of "insurrection."

That's not a crazy position to hold, but the justices in the majority probably resisted it, because they know the left is just spamming out one lawfare case after another, and if they left any wiggle room for another series of lawsuits to exclude Trump from the ballot, they'd leap to do that, and we'd have another nine months of actions to bar Trump from the ballot and a bunch more Supreme Court hearings on the constitutionality of these lawsuits.

So the majority said, "No, that's enough of this bullshit. It ends now."
