Russiagate: Flynn Still In

Jeopardy. Not surprisingly, the Democrat dominated D.C. Circus Court has ruled to indulge Judge Sullivan, and allow him to pursue his vendetta against Lt. General Michael Flynn and essentially ruled that he has not exhausted all possible routes with Sullivan. The opinion, hosted at CNN initially, basically concludes that Flynn and the DoJ attempted to short-circuit a legitimate process of inquiry into the DoJ’s dismissal motion. Mandamus cannot take the place of an appeal, the court wrote in its majority opinion, and in this case the appellants didn’t even wait to see if an appeal would be necessary . . .

I have a standing rule never to write about current events in a state of anger; forgive me for violating my own standard… this is infuriating (albeit not unexpected). The two-tiered judicial process to target a ‘transparently innocent’ man continues.

I think the court has signaled that Sullivan's show trial must end -- they ruled that Flynn hasn't made it "indisputable" that Sullivan is too biased to judge this case, but that's not a ringing endorsement. That sounds like a caution flag.

And they ruled that Flynn still has other remedies for Sullivan's behavior beyond mandamus. Again, that's not blessing Sullivan's scheme to appoint his own prosecutor and conduct his own prosecution. It's claiming that Flynn has other remedies for this that he hasn't yet exhausted. (Exhausting all other remedies is a common requirement when seeking an interlocutory (while the case is still be decided) injunction.)

But will Sullivan heed those warnings, or will this ignorant incompetent miss them?

And what if he does miss them? This court has now announced itself as nothing more than a Democrat Star Chamber. Will they rebuke Sullivan after working so hard to spare him even a mild rebuke?

And by the way: Remember the NeverTrumpers (who are liberal Democrat partisans, straight up, no asterisk) are always dismissing your concerns about partisan judges as "But Muh Judges."

The lesson here is that this was not a hard case. Whether to dismiss the case is a tough call. Conventional wisdom says Judge Sullivan won’t deny the Government’s motion, and I agree he probably won’t, though I think there’s a decent argument he should. But no matter what you think about the merits, this was never a valid case for mandamus. Never! Only partisans and people who had totally lost their perspective (there’s almost complete overlap there, by the way) thought that the dishonest panel decision made any sense. It never did, and today the rule of law was restored for a brief moment. Hats off to the en banc panel.

I believe that. The Russians have always been ready and willing to stoke, (not "stroke", Joe, you idiot) racial flames in America to weaken us. But much like the infamous Facebook posts in the 2016 elections, their efforts are rounding error in the Democrat's efforts to inflame racial unrest for their own perceived political purposes.
