Interestingly, the DOJ announcement describes the charges with reference to the statute’s inclusion of efforts to oppose or delay execution of a law, not its reference “to conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them …” But watch, the MSM and the Schumer/Pelosi crowd will frame it rhetorically as if the defendants are being charged with conspiracy to overthrow the government.

Raechel Genco was seen on video standing just feet away from Epps on Jan. 6 as he whispered into the ear of her boyfriend, Ryan Samsel, who promptly led a mob that stormed a police barricade. But unlike Samsel, the 38-year-old Pennsylvania woman simply stood by. And unlike Epps, Genco was not seen a day earlier encouraging a crowd to enter the Capitol illegally.

That incident took place just outside the restricted area, but Epps was later filmed well inside the forbidden zone, as was Genco. But of the two, only Genco was charged with a sole count of trespassing on restricted Capitol grounds. She faces up to a year in prison if convicted.

Prosecutors presented a single frame of video footage showing Genco walking on restricted Capitol grounds in their criminal complaint. Epps was also filmed on the steps of the Capitol building in front of a police line, well inside the restricted area.

When he entered the sacred Senate chambers, Hodgkins carried with him a weapon so offensive that the mere sight of the device prompted the judge in his case to question Hodgkin’s loyalty to his own country. That weapon was a flag bearing the words “Trump 2020.” 

Although Hodgkins did not commit a single violent act on January 6, federal prosecutors nonetheless consider him a domestic terrorist and want him punished accordingly.

“The need to deter others is especially strong in cases involving domestic terrorism, which the breach of the Capitol certainly was,” a prosecutor wrote in a July sentencing motion, asking a judge to send Hodgkins to prison for 18 months after he pleaded guilty to one count of obstruction. “Moreover, with respect to specific deterrence, courts have recognized that ‘terrorists[,] [even those] with no prior criminal behavior, are unique among criminals in the likelihood of recidivism, the difficulty of rehabilitation, and the need for incapacitation.’”

Judge Randolph Moss agreed with the Justice Department’s assessment. The Obama appointee claimed the four-hour disturbance at the Capitol on January 6 caused political and personal damage that “will persist in this country for decades.” Moss was outraged at the sight of Hodgkins hoisting a Trump flag. “The symbolism of that act is unmistakable. He was staking a claim on the Senate floor, declaring his loyalty to a single individual over a nation,” Moss ranted before sentencing Hodgkins to serve 15 months in jail.

Sinema says she won't budge on the filibuster, even if that results in Biden's bills being blocked.

Manchin also says that he hasn't changed his mind on the filibuster.

Oh wait, my bad -- those two articles are from June, 2021, and October, 2021, respectively.

Sinema and Manchin have said approximately one hundred times each that they're not voting to get rid of the filibuster, which doesn't stop Democrats from asking them every single week or even every single day.

The Democratic focus in the new year has been on trying to pass some version of voting rights reform. President Biden went down to Georgia and put the effort in stark terms: “Do you want to be on the side of Dr. King or George Wallace? Do you want to be on the side of John Lewis or Bull Connor? Do you want to be on the side of Abraham Lincoln or Jefferson Davis?”
Teixeira appropriately calls that sort of language “unhinged level of hyperbole.”

The Democrats, it’s clear, are watching a re-run from 1964/65. (Or perhaps even 1860, if we are to take that last line seriously—which nobody should.) Republican state legislatures have, across many states in recent months, passed legislation to roll back some of the extraordinary (and often, unlawful) suspensions of time-honored election integrity safeguards during the 2020 election. To the leaders of the Democrat party, this amounts to a return to the poll taxes, firehoses, and dogs of the segregated South.

To Republicans, the two “voting rights” laws would amount to a federalization of elections without precedent in American history. What’s more, it’s a solution in search of a problem. There is no crisis of voting rights in America. As anyone who has tried knows, it’s not very hard to vote in America. It requires a minimal amount of organization and planning, as so many civic duties do. Requirements like meeting deadlines, proving residency, and showing ID do not amount to voter suppression to most reasonable Americans.
