If you were being chased by an enormous, intelligent predator, would you jump in the ships with some aliens who might give you the old anal probe, but probably not eat you?
If I were in the boat, I'd toss the little guy back. While orcas aren't known for eating people, it may just be that they've never been caught, and there's no point in tempting them.
