Flotsam and Jetsam - In Fulton County Nathan Out Fani In

In what must be considered one of the most bizarre rulings to every ooze out of the US judicial system, Judge McAfee decided that, despite the "odor of mendacity" (his words), Fani Willis can continue to persecute Donald Trump in Fulton County, Georgia, provided she gives up the services of boy toy Special Prosecutor Nathan Wade.  Of course, Wade resigned almost immediately, $700,000 dollars later.

Capt. Ed at Hat Hair, BREAKING: McAfee Splits the Fani Baby? "So Willis acted unprofessionally in the courtroom and contributed to an "odor of mendacity," establishing "an appearance of impropriety" ... but McAfee wants to let Willis resolve the situation because she's just so darned trustworthy, or something." Curtis Houck@CurtisHouck "So, if I have this right, Fulton County Judge Scott McAfee decided to pull a James Comey, Robert Mueller, and Robert Hur: Write a ruling saying Fani Willis and Nathan Wade are guilty as hell, have no ethics, and aren't good role models....BUT Fani can stay." Althouse, "Judge Says Fani Willis Can Stay on Trump Case, but Only if Former Romantic Partner Leaves." "The NYT reports." "The court could not find that the Willis/Wade relationship began before she hired him because Terrance Bradley's testimony was so weak. And Robin Yearti's testimony "lacked context and detail." But there was "an odor of mendacity" to Willis and Wade's testimony — and that is part of the "appearance of impropriety." The court found Willis's "church speech" "legally improper" but not the point where it "denied the opportunity for a fundamentally fair trial" or required Willis's disqualification." The Dersh at his substack, That's forbidden love! ALAN DERSHOWITZ slams Georgia judge for letting DA Fani Willis continue her war on Trump despite paying her 'lover' with taxpayer dollars... "... it's more proof of America's rotten justice." "Trump and his co-defendants should seek an immediate review of this gross injustice by an appellate court. Certainly, if the former President or any others are convicted, there will be grounds to seek those convictions be overturned." Capt. Ed adds |I'll go Dersh one step further: the explanations Willis offered about cash stashing and undocumented reimbursements sound custom made for a RICO predicate -- more so than the indictment she filed against Trump et al." As I wrote earlier, the problem with splitting the baby is that the baby dies. This has effectively drained whatever credibility remained in this proceeding in Fulton County. Robert Hur report and testimony is the biggest elephant in the room. The term "arbitrary enforcement" used frequently by both the defense and Judge Aileen Cannon. Cannon hammered the fact no former president or vice president has been charged under Espionage Act for taking and keeping classified records including national defense information--which represents 32 counts against Trump in Jack Smith's indictment. Prediction: Cannon won't dismiss the case based on the motions debated today--vagueness of Espionage Act and protection under the Presidential Records Act. But it's very likely she will dismiss the case based on selective prosecution, a motion still pending before her."

At PM, Supreme Court rules public can sue officials who block, mute them on social media. "The ruling was unanimous." Dan McLaughlin at NRO, cited at Hat Hair thinks The SCOTUS Ruling on Social-Media Blocks Is a 'Bad Result'. Capt. Ed comments "After reading Dan's analysis, I read the opinion in Lindke v Freed and found it nearly impenetrable. It misses the forest for the trees in its attempts to grapple with the idea that every social-media post is in itself a public forum of some sort. Under this rubric, courts will have to engage in fact-finding as to whether officials were acting 'under color of authority' even on personal accounts in determining whether a block violates First Amendment rights. That's nonsense. The "public forum" is the platform, not individual posts. Blocking trolls doesn't deny them the right to speak -- it just denies them access to an account on the platform. They can still post away to their hearts' content. And as Dan writes, it's very disappointing that not one justice figured that out. "

It's a PATRIOT Act for social media, and it follows on the heels of the exposure of the Big Tech-Gov't Big Brother Operation that suppressed dissent and silenced criticism of the government during the pandemic, including the silencing of the New York Post on Twitter.
