US President Donald Trump on Monday enacted a pause on non-immigrant visa, including the coveted H1B, till the end of the 2020, as a measure to safeguard jobs as job losses pile up in the economy during the ongoing COVID-19 pandemic. The move is expected to hit India hard, and has drawn criticism from the Indian and American tech fraternity. Further, Trump also extended a pause on the issuance of immigrant visas. In April, Trump announced a 60-day pause on the admittance of aliens into the US as permanent residents.
In a press release by the White House, the Trump stated through a presidential proclamation that it will be putting a stop on all these non-immigrant visas till the end of 2020, as "many workers have been hurt through no fault of their own due to coronavirus and they should not remain on the sidelines while being replaced by new foreign labor." The proclamation states that from Februrary to April, 20 million jobs (2 crore) were lost in industries that seek to fill them through visa like the H1B and L. 17 million (1.7 crore) jobs have been lost in industries seeking to fill jobs through the H2B.
The announcement not only covers the H1B, but also visas falling under:
- The H2B (for seasonal, non-agricultural workers)
- Certain L visas (consists of the L1, enabling intra-company transfers)
- Certain J visa (concerning students, study and exchanges)
The rules will apply to aliens who are outside the US or does not already possess non-immigrant visas or entry documents. It will kick in from June 24, and expire on December 31 this year. According to US Customs and Border Protection, an immigrant visa lets its holders live permanently in the US.

Coronavirus: Mexicans demand crackdown on Americans crossing the border
Mexican protesters have shut a US southern border crossing amid fears that untested American travellers will spread coronavirus.Meanwhile, back in the USA, Democrats Discover Border Security – Rhode Island Governor Orders National Guard Checkpoints To Protect Against New Yorkers… (Sundance at CTH)
Residents in Sonora, south of the US state of Arizona, have promised to block traffic into Mexico for a second day after closing a checkpoint for hours on Wednesday.
They wore face masks and held signs telling Americans to "stay at home".
Mexico has fewer than 500 confirmed Covid-19 cases and the US over 65,000.
The border is supposed to be closed to all except "essential" business, but protesters said there has been little enforcement and no testing by authorities.
The blockade was led by members of the group Sonorans for Health and Life, who called for medical testing to be done on anyone who crosses from the US into Mexico.
Jose Luis Hernandez, a group member, told the Arizona Republic: "There are no health screenings by the federal government to deal with this pandemic. That's why we're here in Nogales. We've taken this action to call on the Mexican President Andrés Manuel López Obrador to act now."

This Is Your Bay on WuFlu
It's pretty clear that EPA resents all the attention being given to WuFlu, and directed away from their pet issues. The Bay Journal, Climate, environment come up short in MD legislative session curtailed by the coronavirus
Chesapeake crab industry remains crippled by visa shortage, coronavirus
In a legislative session cut short by the coronavirus pandemic, Maryland lawmakers approved a ban on an agricultural pesticide and passed a handful of other environmental bills before hurrying home Wednesday. Those legislators chose to save their own lives first, dammit!
But the General Assembly’s first work stoppage since the Civil War stalled dozens of bills that looked highly likely to pass. That number encompassed several environmental and climate change-related measures that will have to wait until a possible special session during the last week of May.
The Maryland General Assembly failed to pass any major climate-related legislation during its shortened session.
“I don’t think this is a session like anybody has ever seen,” said Kristen Harbeson, political director for the Maryland League of Conservation Voters. “There were a lot of things we were hoping to get done that we just weren’t able to.”
Many bills that conservationists supported sailed through one chamber or the other. But as lawmakers and a skeleton staff rushed to finish the state’s business during the session’s final days, some of that legislation got left behind, groups say.
Chesapeake crab industry remains crippled by visa shortage, coronavirus
Responding to employers’ calls, including those of crab meat processing companies in Virginia and Maryland, the federal government announced March 5 that it would release an additional 35,000 temporary visas for foreign workers.Quick, let's let in a bunch of Mexicans in the midst of the epidemic! What could go wrong? They won't get sick, will they?
That still may not be enough to quench the Chesapeake Bay seafood houses’ demand for temporary workers, according to the trade group that represents the industry. And they may still arrive too late to help much or perhaps get stuck on the other side of the border, as the United States today closed its Mexican border for unessential travel because of coronavirus concerns.
Several seafood company owners and watermen had implored the Trump administration to issue 64,000 more visas, the cap set by Congress.
Jack Brooks, co-owner of J.M. Clayton Seafood Co. in Cambridge, MD, and president of the Chesapeake Bay Seafood Industries Association, said he expects a worker shortfall, despite the government’s action.
Initially, the Department of Homeland Security doled out 33,000 work visas, which are in effect for six months beginning April 1. With the added 35,000 visas, the total still falls well short of the 100,000 slots that U.S. employers nationally had sought to fill.
The agency will likely conduct a lottery to determine which companies obtain visas, Brooks said.
“It’d be great to think that all of [the crab houses] get lucky and win, but I don’t think the odds are great that they all get staffed up,” he said.
The temporary visas, known as H-2B visas, are made available annually to workers in seafood, landscaping, construction and other seasonal fields. To be eligible, employers must prove there aren’t enough domestic workers willing or able to fill the positions.
Only three of the county’s nine picking houses had received their workers during the first visa release, businesses say.
Now, because of the sweeping coronavirus pandemic, it’s unclear if and when the additional 35,000 workers will arrive, said Amanda Wright, CEO of Virginia-based Phoenix Labor Consultants.
Releasing those visas “is not even being talked about now” at the federal government, said Wright, whose clients include Chesapeake seafood processors.
Mexico is one of the main sources of seafood workers. Its likely they will be considered essential workers, but the United States has shuttered its embassy consulates in Mexico, which threatens to halt the visa application process.

| Jose Lopez-Gonzalez |
Last summer, so many illegal alien rapists were released by sanctuary Montgomery County that it sparked a fight between DHS officials and local politicians. Acting Deputy Secretary of Homeland Security Ken Cuccinelli even challenged county executive Mark Elrich to a debate and referred to the wayward county as “Loco in MOCO.”
In the latest case last Thursday, local police arrested Jose Lopez-Gonzalez, 35, an illegal alien from El Salvador, for raping a semiconscious woman in an office building stairwell in Wheaton, Maryland. WJLA’s Kevin Lewis obtained police documents describing the graphic details.
“Lopez-Gonzalez was on the top of [the victim] who was naked from the waist down,” police wrote in court documents filed late last week in Montgomery County District Court. “[The officer] advised that he initially yelled at Lopez-Gonzalez to get off [the victim] but that he had to physically pull him off her because he was still engaging in sexual intercourse.”
Lopez-Gonzalez is being held without bail after police charged him with rape and assault. Otherwise, Montgomery County police, pursuant to county policies, would likely be forced to release him without honoring the ICE detainer. That’s what happened last week in Boston when an illegal alien who was accused of raping a drunk woman in a similar incident was released onto the streets. Luckily, ICE found him before he could victimize anyone else.
According to ICE, Lopez-Gonzalez was previously deported to El Salvador in 2007 and 2010.

Stacy McCain, Men Accused of Raping 11-Year-Old Girls, But Don’t Expect Feminists to NoticeThese cases don’t fit the “intersectional” narrative:So, they sneak into the country illegally, go to our schools on our tax money, and rape people. Remember, there is one party that wants to stop illegal immigration, and another party that wants to throw the border open to all comers, and provide free governmental services to all. Vote accordingly.
Two Montgomery County Public School students — ages 20 and 19 — were recently arrested at their respective high schools, on allegations they raped different 11-year-old girls at apartments located off-campus.How nice of the police to provide a Spanish translator so that the 19-year-old could explain how he had consensual sex with an 11-year-old. And this raises the question, of course, about why a Maryland high school student requires a translator. This is explained:
Jonathan Coreas-Salamanca, 20, and Ivan Reyes Lopez, 19, are each charged with second-degree rape. Coreas-Salamanca has additional counts of sexual abuse of a minor and third-degree sexual offense.
According to law enforcement sources, police arrested Coreas-Salamanca on February 13, at Montgomery Blair High School in Silver Spring, where he is enrolled as a student. Six days later, on February 19, police arrested Lopez at Bethesda-Chevy Chase High School where he is enrolled as a student.
Coreas-Salamanca is accused of providing an 11-year-old girl with a cell phone sometime last year. He allegedly used that device to exchange explicit text messages and photographs with the girl, plus arrange sexual meetups.
On Christmas Eve, the victim’s father came across the phone and was stunned to find scores of text messages describing “vaginal intercourse, fellatio, and cunnilingus.”
“[The victim’s father] described a text message where Suspect Coreas-Salamanca advised Victim A that she bit his penis the last time she performed fellatio,” court documents state. “Suspect Coreas-Salamanca’s purpose in sending the text message was to teach Victim A how to better perform fellatio.” . . .
According to court documents, Coreas-Salamanca had been living along the 7700 block of 25th Avenue in Adelphi, Md. According to U.S. Immigration and Customs Enforcement, the Salvadoran national is living in the U.S. illegally. The federal law enforcement agency has filed an immigration detainer with the Montgomery County Department of Correction and Rehabilitation. The fact that these adult men, one from El Salvador and the other from Honduras, were attending Maryland high schools raised questions:
Court documents state Lopez emigrated from Honduras nearly three years ago. He had been living in an apartment with his uncle along the 8800 block of Lanier Drive in Silver Spring.

From CTH, A Divided Supreme Court Rules Illegal Aliens Can be Prosecuted for Identity Theft on Employment Eligibility…
Linked at Pirate's Cove in the weekly Sorta Blogless Sunday Pinup and links.
It should not be a 5-4 split and majority decision, but that just goes to reflect how radical and structurally political the Supreme Court has become. In an important ruling today the Supreme Court ruled 5 to 4 that illegal aliens can be prosecuted by the states for stealing the identity of U.S. persons on employment eligibility paperwork. [Direct pdf link]Is there any doubt how Merrick Garland would have voted?
Stunningly four justices (BREYER, GINSBURG, SOTOMAYOR, and KAGAN) dissented from the majority decision; and instead gave their minority opinion that federally mandated I-9 employment eligibility certifications should not be permitted for use as evidence in cases surrounding identity theft.
According to the dissenting opinion, if your identity or social security number was stolen by an illegal alien; and used to falsify employment eligibility documents; that illegal action is not itself criminal conduct because the documents are not permissible as evidence to show the alien falsified information. An absolutely bizarre position in a nation of laws.
The primary issue surrounds federal laws that state employment affidavits, like an I-9 eligibility declaration, cannot be used to prosecute illegal aliens, unlawfully residing in the U.S. However, it is simultaneously unlawful under federal law to provide false information on those employment eligibility documents.
Thankfully the five majority justices (ALITO, ROBERTS, THOMAS, GORSUCH, KAVANAUGH) saw the abject stupidity of the lower court ruling (Supreme Court of Kansas) reversing and remanding the prior decision. Justice Alito wrote the majority opinion and pointed out the ridiculous outcomes if such considerations were extended.

Reasons #6428 and 6429 that Trump was Elected
A twice-deported illegal immigrant accused of murdering three people is on the run in California.Well, at least he won't be collecting welfare, Supreme Court OK's Public Charge
Three bodies were found in a Perris, California, cemetery, and the Riverside County sheriff said 33-year-old Mexican national Jose Luis Torres Garcia is the primary suspect in what appears to have been an execution-style killing. He is on the run and considered armed and dangerous.
"At this time, we believe this person acted alone in the homicide. He should be considered armed and extremely dangerous," Riverside County Sheriff Chad Bianco told the public. "Do not make contact with him. Notify law enforcement immediately."
Garcia already had an active warrant for his arrest for drunk driving and a warrant for drug crimes, according to KESQ News. He has been deported from the United States twice but returned to California, a state known for its sanctuary city policies.
Authorities believe Garcia knew the deceased victims, 28-year-old Rodrigo Aguilar-Esepejel, 38-year-old Jose Maria Aguilar-Espejel, and 50-year-old Jaime Covarrubias Espindola.
"The suspect and victims knew each other," Bianco said. "The normal resident of Perris has nothing to fear from him. This was not a random killing. There was a reason for the four of them to be together."
Bianco added that it was possible the suspect had fled to Mexico and said local authorities were "working with our counterparts across the border” to bring Garcia into custody.
he January 27, 5:4 decision is a big win for President Donald Trump and his populist advisers, partly because the court also slammed lower-court judges who impose nationwide rules in lawsuits that involve a few local plaintiffs, as reported by Breitbart News.Because, shut up!
The decision allows the public charge rule to be applied while lower court judges hear arguments from advocates and critics. Eventually, the rule may be blocked by the judges, but it will operate for some time to exclude people — such as unskilled chain-migrants, or the elderly parents of migrants — who will likely use welfare or government-run healthcare programs.
The rule is also a win for Americans employees, whose wages are being suppressed, and housing costs are rising amid the business-backed inflow of roughly 1 million immigrant workers, consumers, and renters each year.
Democratic legislators denounced the win.

Reason #6422 that Trump was Elected
Today the Supreme Court granted the Trump administration’s request to continue enforcement of the “public charge” rule on immigration. The SCOTUS decision allows the government to enforce a provision of federal immigration law banning non-citizens from receiving a green card if the government believes the applicant is likely to become a “public charge” – or reliant on government assistance. And Trump fought for and won the election, and Gorsuch's nomination.
The ruling blocks a nation-wide injunction put into place by a single activist judge.
WASHINGTON – […] The Monday order followed a 5-4 split vote that divided the court’s conservatives and liberals. Here’s the ruling:
At issue is the administration’s rule issued in August that would restrict immigrants entering the United States if the government believes they will rely on public assistance, such as housing or health care benefits. Lower federal courts had blocked the policy from being implemented while the issue is being litigated.
The court’s liberal justices, Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan, would have blocked the regulation’s enforcement.
After losing at the lower courts, the Justice Department asked the high court to intervene, allowing temporary enforcement until the issue is resolved on the merits. The states of Connecticut, Vermont, and New York, as well as New York City and immigrant rights groups had brought the suit.
The Trump Justice Department has gone repeatedly to the Supreme Court to lift court-ordered injunctions, bypassing the traditional appellate process.
Justice Neil Gorsuch — supported by Justice Clarence Thomas — wrote a separate concurrence, criticizing the increased reliance on nationwide injunctions to block government policies. (more)

| Maria Fuertes |
At a press conference this morning, Acting ICE Director Matthew Albence blamed New York’s sanctuary city policy for the rape and murder of a 92-year-old woman named Maria Fuertes. “Make no mistake. It is this city’s sanctuary policies that is the sole reason this criminal was allowed to roam the streets freely and end an innocent woman’s life,” Albence said. Later he added, “One simple phone call and Maria Fuertes could be alive today.” Here’s how the NY Times reported Fuertes’ death last week:
On Monday evening, while taking what neighbors described as one of her regular strolls, Ms. Fuertes was attacked just steps from her home by a man who approached her from behind and knocked her to the ground, the police said.
Ms. Fuertes was found lying in the street and later pronounced dead. Investigators are now seeking to determine whether she was sexually assaulted, the police said at a news conference on Friday.
A suspect, Reeaz Khan, 21, also a resident of South Richmond Hill, fled the scene and was later arrested and charged with murder and sex abuse, authorities said.
![]() |
| Reeaz Khan |
Fuertes was the neighborhood cat lady who would collect cans and bottles in a shopping cart and used the money, in part, to feed her 10 cats. Reeaz Khan is in the US illegally and had been arrested last November for an assault on his own father with a broken coffee cup. After his arrest, ICE issued a detainer asking the city to notify them before Khan was released. Instead Khan was released shortly after his araignment and two months later he was arrested for the murder of Maria Fuertes. After ICE published a press release blaming her death on the city’s sanctuary policy, the city denied that it had ever received a detainer for Khan:They voted poorly.
The New York City Police Department disputed the claim on Tuesday, saying that it “did not receive an ICE detainer in regard to this individual” after he had been arrested on Nov. 27, said Sgt. Mary Frances O’Donnell, a department spokeswoman. In other words, the city lied. Acting Director Albence pointed out at today’s press conference that the denial by the city was especially odd because New York brags on one of its websites about not responding to the detainers they do receive. “That’s why it’s so disingenuous when they came out in this instant case that they never received an ICE detainer. What’s the difference? They said themselves they didn’t honor a single one last year.”
On Wednesday, ICE released a copy of the fax transmission form appended to the detainer, which was dated Nov. 27.
Again, they did receive a detainer in this case, contrary to the city’s denial, but Albence is right that, given the city’s sanctuary policy it wouldn’t matter whether they had or not. “If you’re going to have a sanctuary city policy and you know it’s going to result in people going back into the street and committing more crimes, at least own it. At least stand up and say that’s our policy. Own it. Don’t sit there and try to pass the blame onto somebody else. It’s disgusting,” Albence said.

Monkey County Rethinks Sanctuary Policy
From Teach at Pirate's Cove, Montgomery County, Maryland, Reverses Anti-ICE Policy In Wake Of Rapes By Illegals
Who would have thought that Bad Things could happen when Open Borders advocates release illegal alien criminals in order to thwart ICE?Not to mention a few MS-13 murders. Well, you get what you vote for.
Montgomery County Reverses Sanctuary Policy After String of Illegal Immigrants Charged With Rape
A county in Maryland has partially reversed a sanctuary policy just three months after it was passed. The move comes after a string of illegal immigrants have been charged with rape in Montgomery County. So, what they’re trying to do is partially have it both ways. They still want to release the illegals, but, they want to blame ICE if they don’t arrive under those conditions and insulate themselves from condemnation when the illegals do get released and go on to commit crimes. Like continuous rape of an 11 year old girl over a month by illegals ordered deported by a federal judge after already being deported once and were then released by Montgomery County. And many other rapes
The policy banned Immigration and Customs Enforcement (ICE) officials from accessing secure portions of Montgomery County jail. It’s reversal, which was effectively immediately, means ICE can now access “identified areas” of the jail to “ensure that transfers are conducted in a safe environment.”
The policy says ICE must submit an immigration detainer and arrive at the jail an hour before the inmate is set to be released, reported WJLA. If ICE fails to comply for whatever reason, the county will release the illegal immigrant into the community, just as the county was doing before, regardless of the crime the person has been charged with.
Montgomery County Executive Marc Elrich’s rolled back jail ban still prohibits ICE officials from accessing secure parts of the jail unless there is a pre-authorized custody transfer that meet the stated requirements. The ban also prohibits ICE agents from entering “non-public areas of all county-owned facilities” including libraries, police stations, and recreation centers.

By The Way, Trump Administration Just Scored Another Safe-Third-Country Agreement In Central America Today (Yesterday)
No biggie, just the last link in a fence that might end up mooting much of the asylum debate in Congress. While most of the attention today has focused on Ukraine, the White House announced a new agreement with Honduras to take any refugees seeking asylum first rather than the US. That makes three nations with safe-third-country agreements in Central America that effectively blocks the land route for asylum seekers from south of Mexico:
The Trump administration reached a deal with the government of Honduras to enhance the Central American nation’s asylum capacity. The Trump administration has attempted to get around the gridlock in Congress by using its diplomatic authority to deal with waves of asylum seekers. Most of these cases turn out not to qualify, with the request dealing with economic issues rather than oppression. In 2017, the most recent year for which DHS has statistics, the US received 139,801 affirmative asylum cases, where the person applies on arrival, and processed an additional 119,303 defensive asylum cases (filed when the DoJ attempts to deport a person). Only 26,568 were approved combined for both categories, for an approval rate of 10.3%.
The agreement, signed Wednesday, is similar to agreements previously reached with the governments of El Salvador and Guatemala, a senior Department of Homeland Security (DHS) official told reporters on a phone call.
The official said migrants who had an opportunity to seek protection in Honduras, El Salvador or Guatemala will be returned from the U.S. border to seek asylum or protection in one of those countries under the recent agreements, including the new Honduras accord.
The U.S. and international organizations will work to help build upon Honduras’s current systems and processes to expand its asylum capacity, the official said.

Non-citizens made up 64% of ALL federal arrests last year, report finds
Despite making up only seven percent of the U.S. population, non-U.S. citizens accounted for almost two-thirds (64 percent) of all federal arrests last year, according to newly released government numbers. The statistics are part of a report issued Thursday by the Bureau of Justice Statistics titled “Immigration, Citizenship, and the Federal Justice System, 1998-2018.”The system is broken. Build the wall.
“In 1998, 63% of all federal arrests were of U.S. citizens,” the report explains. “In 2018, 64% of all federal arrests were of non-U.S. citizens.” The report explains during the 20-year time frame, arrests of non-citizens “more than tripled” while citizen arrests rose 10 percent.
One of the places where immigrant arrests have risen most sharply is, not surprisingly, the southern U.S. border. There are five federal judicial districts along the border: The Southern District of California, the District of Arizona, the District of New Mexico, the Western District of Texas, and the Southern District of Texas. The percentage of federal arrests in these districts have increased from 33% in 1998 to 65% in 2018. Those districts also saw a quarter (25.1 percent) of federal drug arrests in 2018. And these numbers are only for five federal judicial districts out of the total 94.
Furthermore, as the U.S. has faced a border crisis primarily driven by migration from Central America, the number of Central Americans arrested in the border districts increased from 13,549 in 2017 to 37,590 in 2018. There were 1,171 total federal arrests of Central Americans in 1998.
The report also finds that among prosecutions in U.S. district court, only .3 percent of non-citizens were tried for first-time illegal entry. Of the remaining majority of non-citizen prosecutions, 72 percent were for illegal re-entry, 13 percent were for drug charges, and 4.5 percent were for fraud.
Meanwhile, federal immigration crime arrests almost doubled between 2017 and 2018, from 58,031 to 108,667.

By way of the Wombat's In The Mailbox: 08.22.19, Don Surber outlines The 5.2% illegal alien tax
A Breitbart News report ripping the New York Times -- always a fun read -- revealed the true cost to American workers for allowing illegal aliens to work here.Linked at Pirate's Cove in the weekly Sorta Blogless Sunday Pinup and linkfest.
Released on September 21, 2016, the report said:
- $493.9 billion annually, according to the National Academies of Sciences, Engineering, and Medicine.
- Illegal aliens lower wages by that amount. It is a 5.2% payroll reduction, a tax if you will on workers.
- And unlike federal income taxes that hit the 1% hardest, this payroll tax hits lower wage workers the hardest.
Immigration does make the U.S. economy larger by adding workers and population. But a larger economy is not necessarily a benefit to natives.
Making reasonable assumptions, the NAS report estimates that the actual benefit to the native-born could be $54.2 billion a year. But relative to the income of natives the benefit is very small, representing a "0.31 percent overall increase in income" for native-born Americans (p. 128).
To generate that benefit, immigration has to reduce the wages of natives in competition with immigrant workers by $493.9 billion annually. But business gain $548.1 billion from these lost wages, for a net gain of $54.2 billion.
The same Democrats who promote giving the Chamber of Commerce cheap labor then turn around and pretend to champion the victims of illegal aliens by pushing for $15 an hour wages. The chamber is OK with that because it represents big business that can absorb the rising cost. The small businesses that compete with them cannot as easily absorb those costs.
The study also said, "immigrants do not pay enough in taxes to cover their consumption of public services at the present time. The NAS report presents eight different scenarios based on different assumptions about the current fiscal impact (taxes paid minus services used) of immigrants and their dependent children. All of the scenarios show that immigrants are a fiscal drain. The drain is as large as $299 billion a year."
. . .
Illegal aliens help the 1%. Small wonder the 1% has the most vocal supporters of illegal aliens. Barbra Streisand wants cheap landscapers and maids, which is why Malibu is a sanctuary city.
And if we commoners object it is because we are deplorable.

Illegal Alien, Freed Twice into U.S., Convicted of Murdering 20-Year-Old Jared Vargas
![]() |
| Ernesto Esquivel-Garcia |
An illegal alien, repeatedly freed into the United States by federal immigration officials, has been convicted of murdering 20-year-old Jared Vargas in San Antonio, Texas, last year. And note how well that worked out.
A jury convicted 20-year-old Ernesto Esquivel-Garcia, an illegal alien from Mexico, of brutally murdering Vargas in June 2018 and then leaving his body in an apartment complex before setting it on fire.
Vargas, a cybersecurity student at the University of Texas at San Antonio, was found murdered by Esquivel-Garcia on June 18, 2018, when firefighters arrived at the scene of an apartment set ablaze.
Prosecutors said the illegal alien had brutally strangled and stabbed Vargas to death before setting his body on fire in the apartment complex. The murder occurred after Esquivel-Garcia had been twice released from police and federal custody back into the U.S. and was only given a voluntary deportation order despite having a criminal record.
In March 2017, the illegal alien was arrested for drunk driving and was eventually turned over to the Immigration and Customs Enforcement (ICE) agency. Though he was placed into deportation proceedings, an immigration judge allowed him to post bond, and he was released back into the interior of the country.
In May 2018, a month before Vargas was murdered, Esquivel-Garcia was again put into ICE custody and local police custody but was able to post bond and be released back into the U.S. with only the promise that he would self-deport.
ICE: Undocumented immigrants in Md. rape friend's 11-year-old sister on separate occasions
Two undocumented immigrants are accused of raping an 11-year-old girl on different occasions, the common denominator being a friendship with the victim's older brother.
Montgomery County Police have arrested Mauricio Barrera-Navidad, 29, of Damascus, and Carlos Palacios-Amaya, 28, of Gaithersburg, and charged each with second-degree rape.
Last month, the victim — now 12-years-old — spoke with a social worker at her middle school in Germantown. Talking through tears, the girl shared the painful details about what both men allegedly did to her.

Ace, Trump Administration Releases New Rule That Makes It Easier for the Government to Reject Green Card Requests
It's based on whether you'll be a net drain on the country's resources, so obviously this is both irrational and racist. Why shouldn't we give proto-Democrat voters a salary for invading our country?
The Trump administration on Monday released the final version of a controversial rule that dramatically increases the government's ability to reject green cards for people who are deemed likely to depend on government aid such as food stamps, housing assistance and Medicaid.Self-sufficient? Standing on one's own two feet?!
The new "public charge" rule would link a subject's immigration status to their income and their use of certain public programs.
Published in the Federal Register, the rule will officially be released Wednesday and go into effect 60 days later.
Ken Cuccinelli, the acting director of the U.S. Citizenship and Immigration Services, announced the rule at a press briefing at the White House on Monday morning.
The administration has portrayed the rule as a way to promote sufficiency and independence among immigrants.
"We certainly expect people of any income to be able to stand on their own two feet," Cuccinelli said. "A poor person can prepare to be self-sufficient... so let's not look at that as the be all end all."
All those words are missing is a white hood and a noose.

Democrats reject push to alert ICE when illegal immigrants fail firearm background checks
Democrats this week approved legislation to require background checks for essentially all sales and transfers of firearms -- but rejected GOP-led efforts to amend the legislation to alert law enforcement authorities when gun buyers, including illegal immigrants, fail those background checks.Since felons and illegal aliens are an important voting block for Democrats, it's important not to jail or deport them.
The House Judiciary Committee voted in favor of the bill 23-15, in a strict party-line vote, sending it to the House floor. If approved by the full House, the bill would be the most significant gun-control legislation approved by either chamber of Congress in at least a decade -- although it stands little chance of passage in the Senate, where Republicans command a slim majority.
Republicans in the House charged that H.R. 8, known as "The Bipartisan Background Checks Act of 2019," should have included Florida Rep. Greg Steube's proposed amendment to require that law enforcement be notified "when an individual attempting to purchase a firearm fails a federal background check." (H.R. 8 was numbered in honor of former Arizona Rep. Gabby Giffords, who was shot in Arizona on Jan. 8, 2011 by a mentally ill gunman.)
“Clearly, the Democrats on the House Judiciary Committee don’t care about preventing gun violence, they simply are playing politics with Americans’ Second Amendment rights,” Steube, a Republican, said after the vote. “The fact that Democrats do not want law enforcement notified if an individual attempting to purchase a firearm fails a background check is truly troubling.”
He continued: “In rejecting this amendment, the Democrats have shown their true colors. It is clear they are not interested in preventing gun violence or stopping the illegal purchase of firearms, but rather they are only interested in limiting the rights of law-abiding citizens to advance their own political agenda."

Ace: Barr Eliminates a Commonly Faked Claim for Asylum, That One Is Being "Harassed by Gangs"
Pretty much anyone could say this and there's never any evidence for it -- so the government would have trouble disproving it, even if anyone was trying to disprove it.Note how the Washington Post won't even tell you what the change is before making it clear they disapprove: Immigration lawyers say Justice Dept. ruling could undercut thousands of asylum cases
This is simply not "political persecution," even if genuine.
Attorney General William Barr ruled Monday that being a member of a family harassed by gangs is not enough to qualify for asylum.
In a ruling that will likely block a large number of immigrants from lodging successful asylum claims moving forward, Barr overturned a previous decision made by Board of Immigration Appeals, which found that being a member of family targeted by gangs or other criminal organizations could qualify them as a “particular social group” worthy of U.S. asylum.
A ruling from the U.S. attorney general could upend the asylum claims of thousands of Central Americans and other asylum seekers who say they deserve protection in the United States because they belong to families that are victims of drug cartels or other criminals in their homelands. If fear of drug and gang violence were a legitimate reason for asylum, much of the population of Baltimore, as well as most other major US population centers would be justified in seeking refuge in Canada, not that Canada doesn't have it's own gang violence problems.
The nation’s top prosecutor, Attorney General William P. Barr, issued the ruling Monday, partially reversing a 2017 Board of Immigration Appeals decision in the asylum case of a Mexican national who said a drug cartel targeted him and his family. Barr said that just because members of ordinary families fall victim to “private criminal activity” does not mean they can claim asylum protections in the United States on that basis.
Federal law allows immigrants to claim asylum based on a fear of persecution in their homelands because of their race, religion, nationality, political opinions or membership in a “particular social group,” which for years has included families targeted by gangs, drug cartels or others.

Ace, Democrats Called for Seb Gorka to Be Deported Over Sham Twitter-Based Claims, and Jerry Nadler Even Opened an Investigation Seeking to Deport Him, and the Media Cheered
But showing no shame:
Something you won't see on CNN, ABC, NBC or CBS.
When Democrats threatened to deport naturalized U.S. citizen Sebastian Gorka over phony allegations, the media yawned. But now they can’t stop talking President Trump's tweet that four Democrat members of Congress can “go back to where they came from.” https://t.co/FnCmLsiBSZ— The Federalist (@FDRLST) July 18, 2019
Nadler cited a hit piece written by The Forward attempted to link Gorka to far-right anti-Semitic groups in Hungary. The headline of the article read: "EXCLUSIVE: Nazi-Allied Group Claims Top Trump Aide Sebastian Gorka As Sworn Member."
However, as David Harsanyi at The Federalist points out, the author of this hit piece admitted that there is no solid evidence for its headline or even the smears against him as an anti-Semite.
Here’s Dick Durban’s evil letter to DOJ and DHS, pushing them to revoke @SebGorka’s citizenship based on a total lie. Today’s bed-wetters—who virtue signal like chumps—were silent. https://t.co/VUuJKSht31 pic.twitter.com/dbvSb9Wnqy— David Reaboi (@davereaboi) July 18, 2019
But showing no shame:
Watching the President lie (again) to the American people, spreading racist and xenophobic propaganda against @Ilhan with the crowd being goaded into chants of “send her back” was both chilling and horrifying. There is no place for such racism in our public discourse. https://t.co/SHm3Svb8Mx— (((Rep. Nadler))) (@RepJerryNadler) July 18, 2019

Hmmm . . .
Is the ‘Baseless Rumor’ True? Why Don’t Journalists Do Some Actual Journalism? The question of whether Rep. Ilhan Omar (D-Minnesota) married her brother is an interesting question and, earlier this year at CPAC, I covered a press conference by bloggers who said the answer is “yes.” The persistent accusations that her marriage to Ahmed Nur Said Elmi was a fraud finally prompted the Minneapolis Star-Tribune to investigate, and they could not rule out the possibility that Elmi is indeed her brother:There's a pretty good article at Power Line detailing the evidence that Ilhan married her brother in order to get him admitted to the US: David Steinberg: Tying up loose threads in the curious case
New investigative documents released by a state agency have given fresh life to lingering questions about the marital history of Rep. Ilhan Omar and whether she once married a man — possibly her own brother — to skirt immigration laws.Well, if the Star-Tribune could find nothing to debunk the “baseless rumors,” how do we know they’re baseless? And the investigation raises questions about the purpose of this marriage, which appears to have existed only as a matter of paperwork and might have constituted fraud.
Omar has denied the allegations in the past, dismissing them as “baseless rumors” first raised in an online Somali politics forum and championed by conservative bloggers during her 2016 campaign for the Minnesota House. But she said little then or since about Ahmed Nur Said Elmi, the former husband who swept into her life in 2009 before a 2011 separation.
The questions surfaced again this month in a state probe of campaign finance violations showing that Omar filed federal taxes in 2014 and 2015 with her current husband, Ahmed Hirsi, while she was still legally married to but separated from Elmi.
Although she has legally corrected the discrepancy, she has declined to say anything about how or why it happened.
The new documents also detail the Omar campaign’s efforts to keep the story of her marriage to Elmi out of the press, arguing that detailed coverage would legitimize the accusations and invade her privacy.
Yesterday, Donald Trump challenged reporters to pursue this story:
President Trump on Wednesday repeated the claim that Rep. Ilhan Omar committed immigration fraud by illegally marrying her brother. The question is not whether the “insinuations” are “offensive,” but whether they are true, and why couldn’t the staff of the Star-Tribunedetermine this question one way or the other? It would seem simple enough: Who are Ahmed Nur Said Elmi’s parents? But good luck finding a definite answer to that question, because Somalia is notoriously a failed state, destroyed by civil war and Islamic fundamentalism, and a reporter can’t simply book a flight to Mogadishu, stroll into a government office and walk out with a Xerox copy of a birth certificate for Ahmed Elmi — or Ilhan Omar, for that matter. We are told that she was born in 1982, and that her mother died when she was 2, and while I’m not saying I doubt any of the specifics about her early life in Somali as related by Wikipedia, I’d suspect that finding documentary evidence to verify these details would be difficult. What we know is that she arrived in the United States as a refugee in 1992, when Somalia was being torn apart by rival warlords, and that her subsequent career as a politician puts her on the extreme left-wing fringe of American politics. But let us ask a very simple question: Where is Ahmed Nur Said Elmi now?
Trump made the statement while responding to a question from a reporter from the One America News Network before leaving for a campaign rally in Greenville, North Carolina.
Reporter Emerald Robinson asked the president “if the administration was looking into possible immigration fraud committed by Ilhan Omar for possibly marrying her brother.”
“Well, there’s a lot of talk about the fact that she was married to her brother. I know nothing about it,” Trump said.
“I hear she was married to her brother. You’re asking me a question about it. I don’t know, but I’m sure there’s somebody who will be looking at that,” he added.
Trump’s statement comes amid his ongoing feud with a group of freshman congresswomen known as “the Squad,” which includes Omar. . . .
The claim that Omar illegally wed her brother so he could gain American citizenship first surfaced on conservative blogs in 2016, when she was running for the Minnesota state legislature.
In a statement that year, Omar called it “baseless rumors” that “are absolutely false and ridiculous.”
Omar then said she had married her current partner, Ahmed Hirsi, in the eyes of her Muslim faith in 2002 — but never legally married him. Their partnership ended in 2008.
Omar then legally married Ahmed Nur Said Elmi in 2009, but that union ended in 2011, according to her statement.
“Insinuations that Ahmed Nur Said Elmi is my brother are absurd and offensive,” she said at the time.
If reporters want to debunk the “baseless rumors,” wouldn’t Ahmed Elmi be the obvious source to put an end to this controversy?
The rumor that she perpetrated this fraud on the US immigration system has been percolating for quite a while. Now with actual newspapers taking note, it might be the right time to settle it once and for all. I don't really know what the extent of possible legal consequences are, but I doubt they reach to include sending her back to Mogadishu. Alas.
We have a really powerful tool for determining how people are related, DNA sequencing. All we need are vanishingly small tissue samples from the two people in question. Who knows, maybe it will turn out she's more Indian than Elizabeth Warren!
She wouldn't be the first Congressperson with a shady past, with evidence of tax fraud and antisemitism. Moreover, plenty of Congressmen have been caught in the act, so to speak, and suffered consequences, ranging from not being re-elected, censure, and even jail. She may be one of the most anti-American congresspeople elected so far, but in the modern Democratic party, that doesn't make her that much of an outlier.

President Trump Modifies Asylum Rules…
In an effort to deal with the problem of growing fraudulent asylum claims at the southern U.S. border, the Trump administration is modifying the asylum rules to include a requirement that asylum should be sought at the first safe country of travel.Predictably, ACLU, others file suit in San Francisco federal court to halt Trump asylum ban (WaPoo)
During a video interview U.S. Citizenship and Immigration Services Acting Director Ken Cuccinelli explains the new rule requiring asylum-seekers to apply in the first country they enter instead of the U.S.
(Fox News) – The Trump administration on Monday announced a sweeping new policy tightening restrictions for asylum seekers, in a move that could drastically reduce the number of Central American migrants eligible to enter the United States in this way.
The new rule, published in the Federal Register, would require most migrants entering through America’s southern border to first seek asylum in one of the countries they traversed – whether in Mexico, in Central America, or elsewhere on their journey. In most cases, only if that application is denied would they then be able to seek asylum in the United States.
“Ultimately, today’s action will reduce the overwhelming burdens on our domestic system caused by asylum-seekers failing to seek urgent protection in the first available country, economic migrants lacking a legitimate fear of persecution, and the transnational criminal organizations, traffickers, and smugglers exploiting our system for profits,” Homeland Security Acting Secretary Kevin McAleenan said in a statement, describing the “targeted changes” as critical.
[…] The latest change is meant to crack down on asylum seekers coming to the U.S. more for economic reasons than to escape persecution in their home countries. The new policy does include a couple other exceptions, mainly for certain victims of human trafficking. (read more)
Plaintiffs led by the American Civil Liberties Union filed suit against the Trump administration in U.S. District Court in San Francisco on Tuesday in an attempt to halt the implementation of a new policy disqualifying most asylum seekers who pass through Mexico before reaching the United States.Illegal Alien Charged with Child Molestation in South Carolina "Sanctuary City"
The attorneys suing the government argued in their complaint that the Trump administration lacks the authority to exclude asylum seekers who arrive across the U.S. southern border because U.S. immigration law states clearly that the government cannot disqualify applicants on the basis of how they arrived.
“As part of our nation’s commitment to the protection of people fleeing persecution and consistent with our international obligations, it is long-standing federal law that merely transiting through a third country is not a basis to categorically deny asylum to refugees who arrive at our shores,” the complaint states.
A separate petition seeking an injunction against the asylum change was filed by two other immigrant rights groups in the U.S. District Court in Washington on Tuesday evening.
The lawsuits came just hours after the Justice and Homeland Security departments published an “interim final rule” in the Federal Register that aims to severely restrict the ability of asylum seekers to qualify for safe haven in the United States if they failed to request protections in other nations while en route to the border.
An Asheboro man has been charged with 4 counts of felony indecent liberties with a child among several other charges, according to Randolph County Sheriff’s Office news release. The release says deputies received a report on July 5 about allegations of sex offenses involving a minor.
An investigation into the allegations showed evidence that Victor Estuardo Diaz, 22, of Asheboro, committed acts against a child under 15, deputies say.
Deputies also say warrants for arrest were issued and on Friday, Diaz was arrested and taken to the Randolph County Detention Center. There Diaz was charged with felony disseminate obscene material to a minor, four counts of felony statutory sex offense with a child under 15, four counts of felony indecent liberties with a child and misdemeanor disseminate harmful material to a minor, the release says.
He was given a $250,000 secured bond and his first court appearance was set for Monday.
