Flotsam and Jetsam - Archers and Hunters and Trump, Oh My!

Paula Bolyard at PJM, Here's What Happened at Trump's J6 Hearing Today. NRO reports Trump Pleads Not Guilty to All Four Counts in January 6 Case. Fox, Trump pleads 'not guilty' to charges stemming from special counsel's Jan. 6 probe. "Trump is the first former president in US history to face federal criminal charges" but probably not the last. I could see Joe Biden on trial for bribery and extortion, if he survives long enough to become an ex.

At Da Signal, Surprising What Is—and Isn’t—in 3rd Trump Indictment, Legal Expert Says "So in that sense, it’s strikingly hollow in the sense of no new allegations. And really the big things that are missing are charges like seditious conspiracy or conspiracy to foment insurrections." ET, Unsealed Federal Indictment Against Trump Brings More Serious Charges Than NYC Indictment. Dan Greenfield at Front Page warns The Trump Indictment Criminalizes Political Dissent "Is it legal to disagree with Democrats? The Jan 6 indictment says it isn’t." From Spiked, Nigel Farage says this is a witch hunt against Trump. At USA Today, Jonathan Turley opines Indicting Trump for 'knowingly false statements' about election sets US on dangerous path, "Prosecutors will seek to criminalize false political claims. To bag Trump, they will have to bulldoze through the First Amendment and a line of Supreme Court cases." Harold Hutchinson at Da Caller finds a Former Federal Prosecutor who Says Trump Indictment Is ‘Very Tenuous’:  ‘Potentially A Showstopper’,  Alan Dershowitz Says Jack Smith May Be Indicted If Trump Wins Case: ‘That’s How Serious This Is’. He is pretty much guilty of the same alleged offense. Nick Arama at Red State notes Katherine Herridge: Attorney Points to Big Problem With Trump Indictment—Allegedly Exculpatory Evidence, ignored evidence that Trump really believed election fraud claims. Also from Harold Hutchinson, ‘It’s Not An Abuse’: Bill Barr Defends DOJ From Weaponization Charges After Trump Indictment. He's a DOJ guy; he's pretty much OK with anything they do.  Althouse, "When you look at what's happening, this is a persecution of a political opponent. This was never supposed to happen in America." "This is the persecution of the person that's leading by very, very substantial numbers in the Republican primary and leading Biden by a lot. So if you can't beat him, you persecute them or you prosecute him. We can’t let this happen in America." Said Donald Trump, quoted in "Trump says he's being 'persecuted' for leading polls after pleading not guilty to January 6 charges: 'If you can't beat him, prosecute him'" (Daily Mail)(video at link). Also One way to ensure that rights are not violated is to interpret them as very small. "Get ready for lots of pieces like "The Trump indictment tramples no one’s First Amendment rights." That's by Ruth Marcus in The Washington Post." And  That sounds like the most exciting race ever — like a pitch for a thriller movie. Yes, even that David Brooks piece is about Trump — "What If We're the Bad Guys Here?" Tristan Justice at Da Fed claims Trump Could Have Spent Jan. 6 Talking About The Weather And Still Would Have Been Indicted. Probably. At Da Wire, Trump Lawyer Says Jack Smith Is Endangering American Legal System With Latest Indictment. Red State's 'Bonchie' notes Trump Lawyer's Eyebrow-Raising Comment Hints at the Coming Legal Strategy. Smith asserts that Trump falsely claimed to have been robbed of the election. Sounds like a good excuse to relitigate many of those allegations that were shut down in court for "other reasons." At No Pasaran! Stop Using the Words "Trump Tried to Overturn the 2020 Election"; It Is Akin to Asking "When Did You Stop Beating Your Wife?"

Sarah Arnold at Town Hall sees Matt Gaetz Threaten Jack Smith With Criminal Contempt of Congress "If he ignores the subpoena, we should hold him in criminal contempt of the Congress so that he is the first prosecutor in American history to prosecute a case while himself under criminal contempt." As Dan Chaitin points out at Da Wire, Judge In Trump Election Case Worked At Same Law Firm As Hunter Biden. At the top of the pyramid, Washington D.C. is a very small place. TNP helpfully adds Trump’s Jan 6 Judge Trial is Foreign-Born, BLM Apologist, Obama Donor, Who Has Over-Sentenced Jan 6 Prisoners. Dr. John at Flopping Aces believes Jack Smith is going to prevail in this last indictment. The trial date is everything. Here’s why. I think he'll win in court too, given the judge and the DC jury. I also think it will be overturned on appeal, even if it has to go to the Supreme Court. Ace notices that After Every Major Break in the Hunter/Joe Biden Corruption Investigation, Partisan Witch-Hunter Jack Smith Has Dropped an Indictment of Trump the Next Day "Funny how we always hear that David Weiss "was appointed by Trump," so he can't be biased in favor of the Bidens, but the leftwing propaganda press never points out that Jack Smith was appointed by Biden -- and therefore definitely can be biased against Trump."

Hat Hair's KT, Fulton County Sheriff: Trump will be fingerprinted and a mug shot taken if he's indicted. At Am Think Jack Cashill thinks about How Oppenheimer’s Persecution Mirrors Trump’s. Duane Patterson at Hat Hair VIP has Hard truths about voting for Donald Trump "With the upcoming 2024 Election, we are rapidly approaching a fork in the road as to whether our Constitution guarantees and freedoms will remain in place or not." CNN whines Percentage of Republicans who think Biden’s 2020 win was illegitimate ticks back up near 70%. At HE Dave Marcus asserts Trump's impeachment must be expunged after Devon Archer's testimony.

Speaking of Devin Archer, who, I think we can safely say is off Joe's list of people to pardon as the ship sinks, James Lynch at Da Caller says Devon Archer Appears To Confirm Hunter Biden’s Involvement In Ukrainian Oligarch’s Visa Scheme. At Da Fed the unsinkable Mollie Hemingway claims the Evidence Of Biden Burisma Corruption Is Overwhelming and Elle Purnelle dissect Democrats conflicting claims that Joe Biden Wasn’t Involved In Hunter’s Business And It’s Normal That He Was. At Da Caller, Devon Archer Testimony Transcript Released. PJM's Matt Margolis, Here’s What Devon Archer Told Congress About Joe Biden… and It’s Damning. Althouse, "I think you have to understand that there was no business conversation about a cap table or a fee or anything like that." "It was, you know, just general niceties and, you know, conversation in general, you know, about the geography, about the weather, whatever it may be." Testified Devon Archer, quoted in "Hunter tried to sell family name but Joe Biden never talked business, says ex-associate/Devon Archer’s testimony to House Oversight investigators included his assertion that Hunter Biden was not able to influence his father’s actions or policy decisions" (published August 3rd in The Washington Post). ... This post made me think of a line from Season 2, Episode 6 of "Succession": "I’m outside. I don’t know anything. That’s why I’m useful" (at page 464 of "Succession – Season Two: The Complete Scripts")." Jonathan Turley, The Biden ‘Brand’: Devon Archer Reveals the ‘Niceties’ of Influence-Peddling. Matt Vespa at Town Hall, So, That's What Joe Biden Gave to Devon Archer  "Hunter Biden and his former associate, Devon Archer, got cushy jobs at Burisma; they, in return, got legal protection from investigation and access to then-top Obama officials." At NYPo the divine Ms. Devine asserts it's Crystal clear that Joe Biden was involved in Hunter’s business. Uh oh, PJM's Chris Queen reports Black Voters in Georgia Aren't Automatically Lining up Behind Joe Biden, doesn't matter, if they don't go to the polls, their votes will be "harvested".

In the US credit downgrade, Stacey Lennox at PJM finds Another Historically Bad Moment for the Biden Administration. Breitbart Business Digest: Why the U.S. Credit Downgrade Doesn’t Matter. "No One Buys Treasuries Because of a Rating Agency’s Opinion."

There are interesting questions that follow from the downgrade of the U.S. debt. If the U.S. is not AAA, can mortgage securities backed by government-sponsored entities be AAA? Does it make sense to rate any U.S. based corporation as safer or even as safe as the U.S. government itself? What about corporations and banks that hold excess cash in Treasuries? Should they now be considered riskier? Does China deserve a downgrade because its financial institutions hold so many of the debt instruments of the now-downgraded U.S. government?

Crabs are High This Year

How high? $260 a bushel! Crabs 'sky-high' — watermen explain why

Most Marylanders would say the joys of living on the Chesapeake Bay are the crabs. Steamed up, with Old Bay, beer, ready to pick using a mallet or butter knife. Just as common as the joys of eating them, are complaints about their cost. They go hand in hand.

At Ford’s Seafood in Rock Hall, a bushel of number one’s is $260. At Chester River Seafood they’re $290. Prices are about the same everywhere you look. Those who hear these complaints often are watermen, dropping crabs off at the restaurants.

This blend of unique men, born and raised on the water, get up before sunrise. They labor against waves, the sun, sea nettles, eels, the wind, queasy journalists, and boat maintenance.

As a crabber of over forty years, Robert Ingledue, put it, there once was a time crabbing was a way to make good money. He remembers the boom period. Every line in the water he pulled up, could possibly yield a bushel — about 60 large crabs.

Not now. On July 31, he had 36 lines in the water at Rock Hall. He pulls up 12 a day. He doesn’t usually get a bushel these days off one line.

“I’ll settle for half of that right now,” he said.

So, about half the yield? And still fishing with the same amount of effort? Pretty much the definition of a fishery in trouble.

These watermen are not getting rich off crabs right now. That much is evident. Ingledue explained why that is. There are less crabs out there. There’s less space to run lines. There are invasive species eating them. Blue catfish in abundance.

Before Blue Catfish, watermen blamed Striped Bass, which do, indeed, eat crabs. Pretty soon they'll be blaming Red Drum and Cobia.

And in Ingledue’s opinion, regulations in place to ensure that money can’t be made from the crabs out there. He pointed out that there are even more limitations near the fall, when the cooler water brings out the crabs. And retailers charge double of what comes off the boat, and can be particular about what they pick. Add inflation to the mix, and you’ve got a set up for not so good economic conditions for many watermen.

Ingledue’s boat, Rambling Rose, cost him $25,000, he’s had had to have a fuel pump and fuel lines and other repairs which cost him another $25,000. The typical annual boat maintenance runs another $1,000. Ingledue doesn’t trot line, he works with pots. With 25 on a line — the end are either red or green markers for north and south — he controls a reeling apparatus, a winder, lifting the pots up, saving time and effort from leaning over. The winder costs roughly another $1600, and at $100 a spool and 1,000 feet of line, it’s easy to see how overhead adds up. That’s not incl uding fuel.

Fortunately, crabs are pretty robust, but variable from year to year, largely because of weather. If we have a good recruitment this year, crabs may be abundant in a another year or two, prices will be low, and the watermen will be complaining about that.

Thursday Tanlines

Tel Aviv University researchers have proposed a new theory for why the body’s tanning process does not occur immediately after exposure to the sun’s rays, but only after a few hours or even days.

The study found that the body’s initial response to sun exposure is to prioritize repairing DNA damage in the skin cells, which inhibits the mechanism responsible for skin pigmentation, commonly known as tanning.
. . .
“We have two mechanisms designed to protect the skin from exposure to dangerous UV radiation. The first mechanism repairs the DNA in the skin cells damaged by the radiation, while the second mechanism involves increased production of melanin, which darkens the skin in order to protect it from future exposure to radiation,” explained Elkoshi.

“It turns out that the mechanism that repairs our DNA takes precedence over all other systems in the cell, temporarily inhibiting the pigmentation mechanism. Only after the cells repair the genetic information to the best of their ability do they begin to produce the
increased melanin,” he added.

Flotsam and Jetsam - Trump Indicted Again, Dems Float 'Illusion' of Influence Defense for Biden

We knew it was coming. Given that the jury pool in Florida is likely to be unfriendly to Special Persecutor Jack Smith's "Mar-a-Lago" documents case, he needed a back up in the Democrat friendly Washington D.C. courts. Yesterday, after Joe Biden had an extremely bad day after the revelations of his  participation in phone calls with Hunter Biden and his various nefarious client by Devon Archer, Jack Smith came out with a new indictment in Washington D.C., essentially charging Trump with having defrauded the government by publicly doubting the fairness of the the 2020 election, when he had been advised by many people that there was not sufficient fraud to alter the election results  (Never mind that others were telling him otherwise), and claiming that led to the Jan. 6 melee (without really charging him with inciting the riot).

Kaelen Deese at WaEx, Donald Trump indicted: Jack Smith says 'lies by the defendant' led to Jan. 6

"The attack on our nation's capitol on Jan. 6, 2021, was an unprecedented assault on the seat of American democracy," said Smith, who was appointed to the investigation by Attorney General Merrick Garland last November. "It was fueled by lies. Lies by the defendant targeted at obstructing a bedrock function of the U.S. government, the nation's process of collecting, counting, and certifying the results of the presidential election."

Madeleine Hubbard and Ben Whedon at JTN, Trump indicted in federal election probe on four counts. PJM's Matt Margolis, Trump Indicted by Biden DOJ for His ‘Role’ in January 6. John Sexton at Hat Hair, Trump has been indicted again. Althouse wades through the NYT so you don't have to, Trump — indicted again.  "ADDED: I have a feeling most people aren't going to understand that this is something new! Just in the last few minutes, I've heard: "I’ve officially lost track of all his indictments" and "I don’t know how that’s different from the old news." The NYT seems to recognize this problem. It's also got this on the front page:"  At TNP, Trump Indicted Over Jan 6 in Blatant Election Interference Attempt. NYT cited at Hat Hair, Trump’s Case Has Broad Implications for American Democracy.  Sundance at CTH, Special Counsel Jack Smith Unseals Criminal Indictment of President Trump for Protesting Results of 2020 Election.

Interestingly, nowhere in the indictment is anything criminally alleged relating to the January 6, 2021, events at the U.S. Capitol building in Washington DC. However, you will notice in the Lawfare delivery of the remarks, Special Counsel Jack Smith factually speaks almost exclusively of the January 6th events.

The absence of a criminal charge (ie. seditious conspiracy or insurrection) when contrast against the extreme verbal emphasis of the event as outlined by Smith in the presser, will be missed by most. Speaking of the non-criminal event as the context for a fabricated/stretched criminal allegation, is Lawfare in action. Why emphasize but not charge? Because the DOJ/FBI does not want the risk of litigated discovery and evidence of coordinated government activity therein, that’s why.

Jack Smith knows he is out on a limb with his Lawfare effort to criminalize the legal and constitutional challenge to an election outcome. He is nervous, WATCH:

PM reports Trump says Biden's DOJ sat on charges for 2.5 years in order to interfere with 2024 presidential election "They waited because they wanted to illegally and negatively influence the 2024 Presidential Election." It's not illegal if they don't get convicted. At Twitchy, Andrew McCarthy & Jonathan Turley pour cold water on latest Trump indictments

Matt Vespa is a fan of Turley, How a Law Professor Gutted the January 6 Indictment Against Donald Trump, but it really doesn't matter (until it gets to appeal) because the DC jury pool is so heavily stacked against Trump. 'Bonchie' at Red State, The Judge Assigned to Trump's January 6th Indictment Is Going to Be a Nightmare. The toughest judge for J6 sentencing, appointed by Obama. Kyle Griffin
@kylegriffin1, "The Trump case has been assigned to U.S. District Judge Tanya S. Chutkan. Chutkan, an Obama appointee, is the only federal judge in Washington, D.C. who has sentenced Jan. 6 defendants to sentences longer than the government had requested." Breitbart notes how Trump Indictment Continues Pattern: Day Of, or After, Bad News for Biden. Funny how that works. At WaEx, Donald Trump trial: Former president faces Aug. 10 arraignment in Florida case. At Da Wire, Dan Chaitin reports Georgia Prosecutor ‘Ready To Go’ With Trump Case. Dave Strom at Hat Hair asks At this point, why not bypass the legal niceties and just put Trump in jail? "The Biden Administration has clearly given up on the idea that the federal government exists to do anything but satisfy Joe Biden’s whims. So why not get it over with? Throw Donald Trump in jail without due process, construct reeducation camps, and rename the FBI the Stasi?"

Back in Bidenland, the word has gone out for Democrats to spin the story that yeah, maybe Hunter was selling the 'illusion' of access to Joe, who would never to anything like demand that the govt of Ukraine fire the prosecutor looking into corruption at Burisma, the energy company with both Devin Archer and Hunter Biden on its BoD, after having been asked to by Devin and Hunter, with a $10 million bribe being waved around in the background. Poor old Joe was just blinded by fatherly affection. PM, CNN claims Hunter Biden was selling the 'illusion' of access to his father to overseas business associates. "Archer stated that "Burisma would have gone out of business if 'the brand' had not been attached to it." Ace, The Talking Points Go Out: Unable to Deny Any Longer That Hunter Biden Was Selling Access, The Media Now Claims He Was Only Selling the "Illusion of Access," Because Of Course the Incorruptible Joe Biden Could Never Be Bought. "Update: Of course -- Trump indicted again. Is this a real indictment, or just the illusion of an indictment? The real kind, right?" Sundance, Lawfare Rep Daniel Goldman Spins Devon Archer Testimony About Intent of Joe Biden Phone Calls During Hunter Biden Business Meetings. Althouse, "Until it is proved otherwise, I will find it extremely hard to believe that the president was a party to his son’s nefarious schemes."
"But he enabled them. What on earth was Hunter Biden doing on that 2013 plane to China with his father, then the vice president? Why, after all of Hunter Biden’s dealings with Ukrainian energy company Burisma, did Joe Biden countenance hundreds of thousands of dollars in 'art sales' by his son in recent years, art — to my untrained eye — best displayed on the walls of budget motels? Who bought the stuff and why? Why was Joe Biden... so slow to embrace the grandchild that Hunter Biden had fathered? Why, after the younger Biden tried to cop to a plea deal on tax and gun charges, did the elder Biden invite him to, of all places, a White House state dinner?..."

For example, the FBI tried to justify continuing to spy on Page in early 2017 by indicating to the secret FISA court that it had verified a rumor about Page receiving dirt on Hillary Clinton from the Russian government and facilitating a “well-developed conspiracy of cooperation” with the Kremlin to swing the 2016 election in Trump’s favor. But the bureau had corroborated no such thing. Its source was a front-page report in the Washington Post – one the newspaper later retracted after determining it was false, according to two former U.S. officials who have seen the original, unredacted FISA applications and described the passages to RCI.

The embarrassing revelation hasn’t been previously reported thanks to redactions blacking out references to the Washington Post article in the still-partially classified applications. The officials confirmed to RCI that the censored section covers up the FBI’s reliance on the bogus Post story, published in March 2017, as purported evidence supporting probable cause to continue spying on Trump’s former aide. In the sections of the FISA renewal applications blacking out references to the Post, the officials said, the FBI claimed the underlying text was “sensitive information.” The officials spoke on the condition of anonymity because they were not authorized to discuss still-classified sections of the FISA warrant affidavits.

The FBI’s references to the Post story are contained in the April and June 2017 FISA applications. These applications were so tainted by bad information, politics, and glaring exculpatory omissions that after an inspector general’s probe, the Justice Department years later had to secretly concede to a federal surveillance court that they were “insufficient” to establish probable cause to spy on Page and therefore “were not valid.”

Oregon, My Oregon

A triple! At Hat Hair, John Sexton wonders Can Portland be saved?

Of course, but it will take a change in the political order. Either enough voters will have to get mad at the current regime and kick them out and restore a sane government, or enough working voters will vote with their feet and leave, allowing the city to collapse Detroit style. Once a sufficient number of workers leave, the system will collapse financially, the parasite state of government workers and homeless that has formed will be starved for tax funds and hollow out. This calls to mind Rome's collapse from a 500,000 under the Roman empire, to a town of 30,000 after the Goths sacked of the city. At that point, the road back is long and painful, but possible.

Speaking of the Goths sacking the city, also from John Sexton, One addict says, 'Portland is a homeless drug addict’s slice of paradise'

“Portland is a homeless drug addict’s slice of paradise,” said Noah Nethers, who was living with his girlfriend in a bright orange tent on the sidewalk against a fence of a church, where they shoot and smoke both fentanyl and meth.

He ticked off the advantages: He can do drugs wherever he wants and the cops no longer harass him. There are more dealers, scouting for fresh customers moving to paradise. That means drugs are plentiful and cheap.

Downsides: Tent living is no paradise, he said, especially when folks in nearby tents, high on meth, hit him with baseball bats.

PM, Portland’s Multnomah County lost $1 BILLION from 2020-2021, as high earners left city amid riots, pandemic.

According to an analysis of data from the Internal Revenue Service by The Oregonian from income tax returns filed in 2020 and 2021, Multnomah County lost a net 14,257 tax filers and their dependents, many of whom were high earners who could do jobs remotely, resulting in a net income loss of over $1 billion.

Flotsam and Jetsam - Devin Archer Dishes on the Bidens

Two days after the corrupt Garland/Biden DOJ sent a letter to Devin Archer's judge from an unrelated case, suggesting that now would be a good time to put him in jail, pending his appeal of his sentence, Devin Archer testified to the House Committee (not in public). As expected, he testified that Hunter would fairly routinely call Dad while they were meeting potential "clients", and that the purpose of those calls was to sell "the brand," the brand being Hunter's influence with the big guy. As you might anticipate, if you're cynical like me, is that people from different parties have different views of what actually this really means. Republicans are pretty sure this means Joe knew Hunter was selling the Biden name, and was going along, and likely pushing policies conducive to the clients interests. Democrats are falling back on the idea that, because Joe did not ask for any cash, or promise any policies on the phone, that Hunter was basically scamming the clients with his promise of influence, and Dad was just an innocent bystander who didn't really understand the purposes of the calls.

He also testified that Burisma wanted Hunter Biden on its board because Joe Biden's "brand" would help Burisma.

Burisma wanted to do business in America. But to do so, Burisma would need to get the investigation into it for money laundering and other crimes quashed.

And then Joe Biden conditioned a one billion dollar loan on Ukraine firing the prosecutor Shokin that was blocking Burisma from making the big dollars in America.

He also said that Burisma almost went bankrupt -- but that the "Joe Biden Brand" helped them escape that fate.

The downside, of course, is possible conviction and incarceration that a federal pardon could not cure. . . .  The infamous “find votes” call appears to be part of it, but IMO if that’s all there is, it’s not enough because arguably it was a request to properly count all votes, not create fictitious votes."

In 1997, the Supreme Court unanimously ruled in Foster v. Love that, as one article carefully explains, “Elections Undecided by Midnight are Void & Preempted by Federal Law.” The Court’s clear ruling must be understood to nullify long counts. At the very least, the issue must be litigated, adjudicated, confirmed, and broadly publicized before the 2024 Election to ensure that the Federal Election Commission will void election results in any jurisdiction that engages in counting past election day, ensuring that it doesn’t again occur.
