Jack Smith didn’t want President Trump to know the prosecution was looking through his Twitter metadata and personal communication, so they went to district court under seal to file their search warrants in secrecy; then banning Twitter (the third party) from telling President Trump about it. The four justices from the DC Circuit Court of Appeals are furious the other three members of the court went along with this precedent setting usurpation of authority.

President Trump could not appeal any part of this process because he was unaware it was taking place. In essence, a star-chamber of secrecy was established and the majority on DC Circuit Court of Appeals is not happy about it.

Jack Smith gained access after Twitter lost the 3-judge Circuit Court appeal decision. So, an en banc full 7-member ruling is essentially moot. The information was released, and Smith had access without President Trump or the White House having any option to assert privilege.

In fact, the material produced by Twitter included several dozen direct messages written by a sitting President. The ruling provides no remedy other than public scrutiny and perhaps fuel for Florida Judge Aileen Cannon who already has Special Counsel Jack Smith on his heels after several rulings in the Mar-a-Lago documents case.

Flotsam and Jetsam - Iowa Speaks, Trump Wins, DeSantis 2nd, Vivek Bails

Have I told you how much it annoys me that Iowa has such outsized weight in our politics yet? Well, at least now we can forget about Iowa for another 4 years, and let them get back to business, growing corn to turn into gasahol. As was entirely expected, Trump won the caucuses handily, taking all 99 counties, with DeSantis and Haley distant seconds and thirds. Vivek Ramasmarmy failed to make enough impression to impress even himself, and announced he was "suspending" his campaign and throwing his support to Trump. Kinda too bad, he added a little curry to the mix. I think the biggest loser of the night was Nikki Haley who was being pushed by the media and the democrats (but I redund) as the sensible center alternative to Trump.

If the Court wants to issue one definitive ruling that will resolve all 14th Amendment challenges nationwide, it has two pathways — and both of them result in Trump victories.,

First, the Supreme Court could rule that only Congress has the authority to set procedures for application of the 14th Amendment and that, in the absence of such enabling legislation, the states are out of luck. (Keep in mind that, while Section 3 of the 14th Amendment contains the insurrection clause, Section 5 provides that “The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.”)

Second, the Court might rule that the 14th Amendment does not apply to the presidency. On one hand, the Amendment’s text does delineate certain offices — senators, representatives, even presidential electors — but not the president (though it does apply to “any office, civil or military, under the United States”). On the other hand, it’s tough to believe the Framers wanted to keep insurrectionists out of all offices except the most powerful one.

If I had to guess — and we are all guessing, perhaps cut with some experience and intuition — I’d go with the former one-shot approach (though the Court could do both).

Flotsam and Jetsam - Hunter Caves

It seems likely someone from the White House, quite possible Sleepy Joe himself, or some high level flunky called Hunter or his lawyer Abbe Lowell, and told them to knock off the funny business with the congressional subpoena. Abbe Lowell is claiming that the original subpoena isn’t valid because it was issued before the full House approved an impeachment inquiry into President Joe Biden. I’m not a lawyer, but that claim is flatly nonsensical. Both chambers issue subpoenas for a variety of reasons all the time. It’s usually a course of last resort after a more informal invitation to appear and testify is declined. Further, while subpoenas may be issued for a full hearing before the House membership, most are issued by committees conducting various investigations. This investigation is being conducted by the Oversight Committee and they issued the subpoena after Hunter refused to appear and testify voluntarily.

There’s a good chance that both Lowell and Hunter know all of this already and they simply don’t care. Hunter Biden is facing multiple criminal charges in court at this point with the possibility of jail time to follow. Being found in Contempt of Congress is not a big deal in and of itself. Nothing will come of it unless the Department of Justice decides to prosecute him and what are the odds of that happening while Joe Biden is the President?
