Mary Chastain at LI reports Trump Orders New Work on Census: Illegals ‘Will Not be Counted’ "“The data collected by the decennial census determine the number of seats each state has in the U.S. House of Representatives.” PJM's Matt Margolis calls it HUGE: Trump Orders New Census to Fix 2020’s Rigged Count Favoring Democrats. At Da Signal, Commerce Department to ‘Immediately’ Make Census ‘Reflect the Number of Legal Residents’ in US. From Althouse "President Trump said on Thursday that he had ordered the Commerce Department to begin work on a new census that excludes undocumented immigrants." ""A new census would be a significant departure for a process stipulated by the Constitution to occur every 10 years. Historically, the census has counted all U.S. residents regardless of their immigration status, a process that helps determine both the allotment of congressional seats and billions of dollars in federal money sent to states. 'People who are in our Country illegally WILL NOT BE COUNTED IN THE CENSUS,' Mr. Trump wrote in a post on social media.... Mr. Trump tried a similar move in 2020 to keep undocumented immigrants out of the census, but a federal court rejected that attempt, and the Supreme Court declined to intervene...." The NYT reports." Amy Curtis @RantyAmyCurtis "Perhaps those blue states shouldn’t have counted on illegal immigrants to inflate their census numbers, huh, Ron?" Quote Ron Filipkowski @RonFilipkowski, "The next part of the plan to steal the midterms and/or the 2028 election - an attempt to do a mid-decade census to take seats and electoral votes away from blue states. I knew this was coming." From the text of the 14th Amendment you can make a pretty good case that illegals should be excluded from the apportionment,
"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice-President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State."
Certainly, illegal aren't eligible to vote, so they should be excluded along with visitors and diplomats. Whether judges read it the same way is a matter for later.
