 WBOC, Maryland Sues 3M, Dupont, Others for Environmental PFAS Contamination

The Maryland Attorney General Anthony G. Brown has announced two lawsuits filed against multiple chemical manufacturers for the alleged widespread contamination of Maryland’s natural resources and damage to Marylanders’ health.

The lawsuit, according to the Maryland Department of the Environment, alleges that the manufacture, marketing, and sale of polyfluoroalkyl substances (PFAS) by these companies, including 3M and DuPont, have polluted the State’s environment and put the health of Marylanders at risk.

The first lawsuit tackles the contamination caused by PFAS present in fire fighting foam that has been used by the U.S. military, airports, industrial facilities, and fire departments. The second suit addresses PFAS contamination from other sources, including consumer products, which were introduced through industrial facilities. That suit includes the use and disposal of the products, landfills with PFAS waste, and wastewater treatment plants with PFAS-contaminated waste streams.

The lawsuit alleges the chemical manufacturers knew the dangers of using PFAS products for years but kept the risks secret and continued the manufacturing, marketing, and sales of their PFAS products in Maryland for profit.

“Those who would choose to pose a risk to Marylanders' well-being must be held accountable,” said Gov. Wes Moore. “By filing these claims, Maryland is making clear that we value health, safety, and preserving our state's precious natural resources for future generations over corporate profits.”

The Department of the Environment says PFAS in humans and animals has been linked to diseases such as kidney and testicular cancer, thyroid disease, high cholesterol, pregnancy-induced hypertension, and low birth weight, and may also impair the immune system.

The two lawsuits aim to recover damages and costs of the investigation, cleanup, restoration, and treatment of Maryland’s natural resources from PFAS contamination. Both suits were filed on behalf of the State of Maryland, the Maryland Department of Environment, the Maryland Department of Natural Resources, and the Maryland Department of Health.

There’s certainly some evidence to suggest that these chemicals can cause harm at high enough concentrations. But there’s also a great deal of observational data showing correlations with all sorts of endpoints that, rather than showing true evidence of harmful effects, may simply reflect that PFAS levels are a good marker for general health (more on that later).

This is inherently the problem with observational research. First, despite all the recent attention, PFAS aren’t a new group of chemicals (1). They’ve been around since the 1940s, and humans have been exposed to these compounds for about 70 years.

They’re present in various products that most people use in their homes: paper and cardboard packaging, Teflon coating, Scotchgard, cosmetics, and the list goes on. The two most widely known are perfluorooctanoic acid (PFOA) and perfluorooctane sulfonic acid (PFOS).

They’re also commonly used in building materials. Given their widespread use and their persistence in the environment (in the air, dust, water, and soil), they’ll continue to be found in our bodies for a long time to come.

However, blood levels of PFOA and PFOS have been greatly declining in the U.S. population since manufacturers have begun phasing them out of products.

While epidemiological studies show an association between these chemicals and cardiovascular disease and all-cause mortality, there are also associations between disease/death and terrible lifestyle choices. That may be confounding the association between PFAS and kicking the bucket.

For example, fast food, pizza, microwave popcorn, ice cream, soda, fried (not omega-3 rich) fish, candy, salad dressing, butter, cheese, and white rice have positive associations with PFAS levels. However, eating at home shows an inverse association with PFAS levels, while going out for fast food is associated with a higher level.

Those eating a diet in omega-3-rich fish, fiber, fruit, and vegetables also show lower PFAS levels (4), while consuming a diet rich in fried fish, low-fiber foods, and high-fat bread/cereal/rice/pasta was associated with higher PFAS plasma concentrations.

This begs the question: Are at least some of these proposed adverse effects of PFAS simply confounded by the fact that lifestyle choices known to improve health are associated with lower PFAS exposure, while unhealthy choices are associated with higher PFAS exposure?

It’s not surprising given that PFAS are found in fast food containers and packaging, non-stick paper, pizza boxes, and plastic used for various foods (butter, microwave popcorn, ice cream, candy).

The House is supposed to vote on the debt deal some time later today, after the 72 hour period to read the 99 page bill (a rule mandated in the agreement to make Kevin McCarthy speaker) has elapsed, and the politicians are doing they're best to keep us in suspense. Getting out of  the Rules Committee will require all but 3 Republicans on it to vote yes, and already two have said no, and a third is on the fence. A key early test will come Tuesday afternoon, when the House Rules Committee is set to vote on the rule governing debate over the measure. Such rules are generally party-line efforts, but two Republicans on the House Rules panel — Reps. Chip Roy (Texas) and Ralph Norman (S.C.) — have emerged as harsh critics of the deal negotiated by President Biden and Speaker Kevin McCarthy (R-Calif.). McCarthy could afford their defections but would have only one vote to spare, assuming the panel’s four Democrats all vote against the rule.

Forget it Jake, It's Baltimore

From PM, Baltimore institutes curfew for teens from Memorial Day through Labor Day in attempt to curb crime

The city of Baltimore is issuing a citywide curfew for minors aged 16 and younger, with officials stating that the goal of the curfew is to keep children and teens safe and to cut down on crime.

According to WBAL, residents received text messages and phone calls on Friday morning to remind them of the curfew, which begins on Friday night and goes through Labor Day weekend.

"Reminder: Curfew ordinance is in effect from 11 pm to 6 am all summer," the text message read. The message also included a link to the B’More Summer Information Hub, which informs residents of summer camps and activity ideas.

For teenagers between the ages of 14 and 16, the curfew goes from 11 pm to 6 am on weekends and holidays. For minors 13 and younger, the curfew starts at 9 pm.

The curfew provides exceptions to the rule, including children out with their parent or guardian, and minors traveling to and from work or a city-sponsored event.

Under the payor's plan, police officers will specifically focus on groups of 10 or more young people. When stopped, identification will not be demanded, nor will there be pat-downs unless a safety issue is present. Officers will not engage with the group until a youth connection worker is present. According to the outlet, police have been instructed to verbally command the group of young people to disperse.

City staff who are not law enforcement are focusing specifically on the Inner Harbor, Fells Point, and Federal Hill.

If seen out past curfew, the minors will be encouraged to go home, or to a late-night center either at CC Jackson Recreation Center or Rita R. Church Community Center, where they will be supervised by staff as they await pickup.

According to USA Today, those who violate the curfew could face up to a $500 fine. The first offense gets a written notice and warning, a second offense gets a $50 fine or family counseling, and a third offense gets a fine of up to $500 or community service for the parent or guardian of the minor.

Encourage to go home or to a rec center? Yeah, that's gonna happen. 

Monterey Bay Aquarium Puts a Hit Out on Chesapeake Bay Oysters

WTOP, Consumer seafood guide advises people to avoid Chesapeake Bay oysters. But why?

The Chesapeake Bay oyster population has been flourishing over the last few years, but a California-based seafood guide disagrees. Seafood Watch, a well-known consumer guide about sustainable seafood, has released its latest draft and is telling people to avoid eating wild caught oysters that come from the Bay.

A look at the draft shows the bay as being overfished and poorly managed, adding “current abundance levels in the Chesapeake Bay overall are still low. As a result, Seafood Watch deems eastern oyster abundance in Virginia as a ‘high’ concern.”

WTOP has reached out to the organization behind the report for comment.
The Monterey Bay Aquarium is behind the guide, but declined a request for comment from the Bay Journal about the rating, saying the draft assessment may change, depending on public comment.

The findings have led to some criticism from the local industry. The University of Maryland Center for Environmental Science told Bay Journal the draft applied an overly broad and uneven brush when rating the bay.

The Maryland Department of Natural Resources also took issue with the findings, saying no one has contacted them from the aquarium about the bay’s condition, adding that the information is outdated and misinterpreted. The department stood behind the state’s oyster management, saying it’s been reviewed favorably by outside scientists.

In 2018, Seafood Watch rated oysters from Maryland and Virginia as a good choice for those looking for a sustainable option.

Actually, it would be better for Chesapeake Bay oysters if they were not fished as hard. If it were up to me, I would have a 5-10 year ban on fishing and restoring oysters in Chesapeake Bay (go ahead and grow all you want), and see if the oysters are capable of expanding their population in the Bay as it exists at present. If not, go ahead and plant some foreign oyster that can, like ariakensis. You'd probably have to provide income support to watermen to make up the difference, but even that would likely be cheaper that current public restoration efforts.

Blue catfish, with their telltale whiskers and silvery cerulean skin, are likely even more hazardous than the snakeheads. Known to balloon in size by feeding on an incredible variety of estuarine life, the invasive catfish are gaining notoriety thanks to their abundance.

But Maryland seafood processors argue that the effort to remove blue cats from the bay for commercial sale has long been hampered by regulations. And even as the catfish continue to seize territory in the Chesapeake — endangering key species from blue crabs to Atlantic menhaden — it’s unclear whether there is sufficient momentum to loosen the red tape.

Unlike with other fish species, every time seafood houses plan to cut up a shipment of blue catfish from a waterman, an inspector from the U.S. Department of Agriculture must be on-site, and the seafood house can’t process any other fish at the same time.

 

The inspection rules were written into the 2008 federal Farm Bill, supported by catfish farmers, who wanted to boost their product with more stringent inspection requirements amid foreign competition. But USDA didn’t actually take authority over catfish from the Food and Drug Administration, which handles other seafood industries, until 2015.

“This was a rule that was many years in the making, because it was unusual,” said William James, a consultant for advocacy groups such as the Catfish Farmers of America. “The catfish industry wanted to be different. They wanted to subject themselves to these increased demands in order to acquire the USDA logo, and enhance the reputation of the product that they sell.”

As a result, USDA inspectors must be present at least once per shift when catfish are being processed. The agency provides the inspections without charge during business hours. And for establishments processing invasive catfish, overtime and holiday pay has been covered by congressional funding since 2021.

 

Maryland lawmakers from Annapolis to Capitol Hill, desperate to slow the population growth in the bay, have opposed the regulations for the wild catfish industry. But as legislators in Washington draft the next five-year Farm Bill, the future remains uncertain, said Keisha Sedlacek, who directs federal advocacy programs for the Annapolis-based Chesapeake Bay Foundation.

There have been some victories, she said, including language inserted by Republican U.S. Rep. Andy Harris of Maryland into the federal omnibus spending bill for FY2023 requiring the agriculture secretary to ”work with the states in the Chesapeake Bay area to assist fishermen and processors dealing with invasive blue catfish.”

But transferring inspection authority for wild-caught catfish back to the FDA has been more challenging, she said.

State Farm said it will no longer accept new applications for home and business insurance in California because of an increase in catastrophic events and construction costs, the company announced Friday.
