Memorial Day 2021 Beach Report

After 2 days of rain and cold, a warm, sunny day on Memorial Day was well attended.

Georgia found the tooth of the day with this 1 7/16 inch prehistoric White Shark tooth.
But I was pretty happy when I stooped down to scoop up this Tiger Shark tooth, and then noticed the small, but complete, except for the root, Cow Shark tooth. 

Time for the local cactus to bloom. Believe it or not, this Eastern Prickly Pear Cactus is native to Maryland, and does well in the sand dunes next to the beach. There are several much larger clumps nearby.

Election 2020 - And Monday Morning Stimulus

Something to go with our coffee. CBS reports Texas Republicans' sweeping voting restrictions bill passes state Senate, and boy are they ever pissed. Of course, what they call voting restrictions are what the rest us call measures to prevent the Democrats from cheating. 

The bill, S.B. 7, includes several controversial provisions that critics say would disproportionately affect poor and minority voters. It also specifically targets voting practices employed this past year in Harris County, which includes Houston, by banning drive-through voting and 24-hour voting. Those practices were used by 140,000 voters in 2020.

S.B. 7 makes it a state jail felony for local officials to attempt to send mail-in ballot applications to voters who did not request them, a practice Harris County employed in 2020. The bill also limits early voting and implements more restrictions on absentee voting, including adding more identification requirements for those who wish to vote-by-mail.

"It’s part of an assault on democracy that we’ve seen far too often this year—and often disproportionately targeting Black and Brown Americans," Biden said in a statement. "It’s wrong and un-American."

He called on Congress to pass the For the People Act and the John Lewis Voting Rights Act, two Democrat-led voting bills that seek to expand voting access, particularly to minority communities.

It would also ban using temporary structures as a voting facility and would strengthen access for poll observers. It also imposes new penalties for poll workers who violate rules in a way that is deemed to interfere with the voting process.

There’s a particular trend pattern to identify DeceptiCons in the Republican party. The Arizona Governor, Doug Ducey, is one easily identifiable member of that club.

The DeceptiCons support leftist goals and objectives; they are paid handsomely for their duplicity to support them; but they hide their support through parliamentarian tricks (cloture votes) and obtuse justification. Cue the demonstration:
Today, I vetoed 22 bills. Some are good policy, but with one month left until the end of the fiscal year, we need to focus first on passing a budget. That should be priority one. The other stuff can wait.

Once the budget passes, I’m willing to consider some of these other issues. But until then, I will not be signing any additional bills. Let’s focus on our jobs, get to work and pass the budget. 

That's just bullshit. It's hard enough to get legislators to do their job the first time, let alone a second, and with enough votes to override a veto.

It rained all day yesterday, with the temperature steadily declining, and we settled for a short street walk. This morning it was still raining, and blowing hard out of the north. By waiting out lunch, we managed to get the rain down to a slight mist by the time we left. It was chilly, and initially I wished I had worn a heavier shirt and gloves. Despite the low tide, much of the beach was eroded back, and tooth hunting  was tough, one broken tooth and a ray chevron. Skye found a couple of people to pet her though, so it was good with her.

Hours before Senate Republicans killed an independent commission to investigate the Jan. 6th siege, federal prosecutors disclosed communications about how Oath Keepers allegedly plotted to storm Washington, D.C. with guns by boat by way of the Potomac River.

Those discussions became public in a filing seeking to maintain the strict pretrial release conditions of Oath Keepers member Thomas Caldwell, whom prosecutors allege organized a group of militia members on “standby with guns in a hotel across the river.” In the brief, prosecutors also alleged that a message from the militia’s leader described a “worst case scenario” where former President Donald Trump “calls us up as part of the militia to to assist him inside DC.”

Pulling a line from one of the immortal verses of Henry Wadsworth Longfellow, the extremist group’s Florida chapter leader Kelly Meggs allegedly imagined the militia members as the modern day equivalent of their American colonial forebears.

“1 if by land,” Meggs allegedly wrote in an encrypted message on the group’s Signal channel, quoting Longfellow’s 1861 poem “Paul Revere’s Ride.”

“North side of Lincoln Memorial,” Meggs’s message continued, according to the government. “2 if by sea[,] Corner of west basin and Ohio is a water transport landing !!”

The alleged Oath Keepers plot to ferry heavy weapons across the Potomac River on a boat was previously reported by the New York Times in February, but prosecutors first made new evidence supporting that claim public on the day Trump’s Republican Party blocked independent scrutiny into the attack.

Clearly, they don't know the Potomac in DC is one of the most heavily patrolled waterways in the country. Do we need more evidence that some of these guys were living in a fantasy?

Fulton County, Georgia, election officials are attempting to avoid an audit of 147,000 absentee ballots. President Trump asks the following: “Why are the Radical Left Democrats in Georgia fighting so hard that there not be a Forensic Audit of 150,000 absentee ballots in Fulton County? There can be only one reason, and that is because they know the vote was corrupt and the audit will show it. Republicans must fight hard and win!”

With witness affidavits saying there was something very wrong about the absentee ballots in Fulton County, a Georgia judge granted plaintiff Garland Favorito with authorization for an audit of the physical ballots and high-resolution scanned images. However, the County officials, the Election Board as a whole and the individual members, are all pointing fingers at each-other saying the lawsuit has identified the wrong defendant.

Plaintiff Garland Favorito appeared this morning for an interview on the current status with Monica Perez. Mr. Favorito explains the current status of the ballot audit as the previously authorized review has been suspended for 30 days pending the outcome of obtuse legal arguments about who is the right defendant.

Former President Donald Trump encouraged Republicans to keep up the fight as he interpreted a push to stop a judge's order allowing an inspection of 147,000 mail-in ballots cast in the 2020 election in Fulton County, Georgia, as evidence of corruption.

He released a statement on Friday after Superior Court Judge Brian Amero canceled a meeting to discuss plans for the review to give him time to consider and rule on motions filed by attorneys for Fulton County to dismiss the overarching lawsuit in which voters sued for access to look for evidence of fraud in November's election. A hearing on the motions has been scheduled for June 21, according to GPB News.

Chris Pandolpho at Da Blaze finds that Facebook bans donations to 147 Republicans who voted against certifying Biden's 2020 victory. The tech monopolies need breaking. 
"As a result of our review, the FBPAC Board has decided to resume contributions, but not to any members of Congress who voted against certifying the 2020 election following the events at the Capitol on January 6," Rice said in an internal memo. "While a contribution to a candidate for office does not mean that we agree with every policy or position that a candidate may espouse, we believe this decision is appropriate given the unprecedented events in January."
Will they apply this in hindsight to the Democrats who voted not to certify Trump or Bush? Of course not.

Russiagate: Re-re-revisited

It's been a while, and it's a cold, stormy day here, so I can't use the excuse that I need to walk the dog. Besides, I already did that. So what's new since we last looked?

In addition, we believe that certain of the conduct examined by the Special Counsel could not, as a matter of law, support an obstruction charge under the circumstances. Accordingly, were there no constitutional barrier, we would recommend, under the Principles of Federal Prosecution, that you decline to commence such a prosecution.

The Left and the media long suspected that the Department of Justice memo upon which former Attorney General William Barr based his decision not to prosecute then-president Donald Trump for obstruction of justice contained a “smoking gun” that would prove Trump guilty and discredit Barr’s conclusions.

Judge Amy Berman Jackson apparently put that theory to rest when she ordered the release of part of the memo that dealt with how Barr reached that decision. Barr relied on advice from several sources, including the Office of Legal Counsel. The OLC recommended against prosecuting Trump, not only because there are constitutional issues with prosecuting a president for obstruction, but also because even if Trump were a private citizen, there wouldn’t be enough evidence to charge him.

The Department of Justice (DOJ) asked the U.S. District Court of Columbia to dismiss a lawsuit filed by former Donald Trump adviser Carter Page over the deep-state witch hunt during which FBI officials spied on Democrats’ political opponents under operation Crossfire Hurricane.

Page filed suit against the Justice Department over abuses of the Foreign Intelligence Surveillance Act (FISA). A federal judge ruled in January last year federal authority granted to spy on Page under the act was “not valid.”  In requesting the D.C. District Court to dismiss the case, the government argued it may abuse the FISA process and unlawfully spy on American citizens without liability.

“Plaintiff alleges that after the Defendants obtained the process — the FISA orders — Defendants used it ‘to spy on the Trump presidential campaign by unlawfully invading the privacy of Dr. Page without probable cause,'” DOJ attorneys wrote. “Even taken as true, which Defendants do not concede, Plaintiff fails to state a claim for abuse of process because conducting surveillance and collecting information for foreign intelligence purposes are exact purposes for which FISA orders are intended; that is, they are the end intended by law.”

In other words, the Justice Department argues that even if warrants to spy on Page were an unlawful violation of Page’s privacy, the government can’t be held accountable.

The government argued Page’s lawsuit also came too late. “The facts alleged in the Complaint and in various judicially noticeable public documents establish that Plaintiff’s claim accrues well more than the two years before he presented it administratively to the Department,” government attorneys wrote.

"Part of me thinks that prosecutors who don't have enough to allege a crime need to keep their mouths shut," he said. "And part of me thinks that this is more than just a criminal investigation. It's an investigation into whether procedures and powers that we give government, whether folks were good stewards of those powers, and you could make an argument that we should know that. We should know whether or not someone abused their authority or their power in a non-criminal way. Create a fraudulent accusation; then leak (or merchandise) the accusation to media; then “merchandise” the media report of the leak as evidence to support the fraudulent accusation. This is precisely what Manhattan DA Cyrus Vance is doing with a leaked story about his grand jury against President Trump. You can tell this is the political motive because grand jury secrecy is dismissed in favor of the media leak.

If the motive wasn’t political, the DA wouldn’t need the leak.

There is nothing more corrupt than an investigation that is in desperate search of a crime. But, make no mistake, that is exactly what is happening here. The Attorney General of New York literally campaigned on prosecuting Donald Trump even before she knew anything about me. She said that if elected, she would use her office to look into “every aspect” of my real estate dealings.

She swore that she would “definitely sue” me. She boasted on video that she would be, and I quote, “a real pain in the ass.” She declared, “just wait until I’m in the Attorney General’s office,” and, ”I’ve got my eyes on Trump Tower.” She also promised that, if elected, she would “join with law enforcement and other Attorney Generals across this nation in removing this President from office,” and, “It’s important that everyone understand that the days of Donald Trump are coming to an end.”

The Attorney General made each of these statements, not after having had an opportunity to actually look at the facts, but BEFORE she was even elected, BEFORE she had seen even a shred of evidence. This is something that happens in failed third world countries, not the United States. If you can run for a prosecutor’s office pledging to take out your enemies, and be elected to that job by partisan voters who wish to enact political retribution, then we are no longer a free constitutional democracy.

A federal judge overseeing an investigation of Rudolph W. Giuliani will appoint an independent attorney to sort through 18 electronic devices seized by federal authorities and shield any content that, because Giuliani is an attorney, may be off limits to investigators examining his foreign contacts while representing President Donald Trump.

U.S. District Judge J. Paul Oetken on Friday adopted a proposal from prosecutors to appoint what’s called a “special master” to review the materials and filter out items that could be considered privileged, a process expected to take months. Attorney-client privilege applies to communications between a lawyer and a client, and such messages are protected as long as they do not advance criminal activity.

Giuliani’s lawyers also have argued that executive privilege applies because he represented Trump during his presidency.

The Justice Department is looking into Giuliani’s dealings with Ukrainian figures ahead of last year’s election to determine whether, in his bid to find information that would prove damaging to President Biden, he violated a law that requires agents of foreign interests to register with the U.S. government. The former New York mayor, who once led the Manhattan U.S. attorney’s office now scrutinizing his activities overseas, has not been charged with a crime and adamantly denies wrongdoing.

FARA is clearly a bullshit law used to punish opponents of the Democrats. If they're serious about it, why hasn't Hunter been charged. He's clearly been representing both the Ukrainians and the Chinese. FARA should be overturned on First Amendment grounds.

The FBI, once the most respected arm of law enforcement in the country, is now an appendage of the Democrat party with the Department of Justice their de facto enforcer. They operate politically through maliciously investigating fictitious allegations (e.g. Trump-Russia collusion), stoking malevolent accusations (e.g. January 6th “armed insurrection”), and pursuing the harshest treatment possible against “wrong-think” transgressors while largely ignoring the anarchists who regurgitate “right-think.”
  2. The federal bureaucracy is a leftist-sympathizing power unto themselves that can willfully destroy a president or a common citizen and face no repercussions.
  3. By exploiting the Chinese Coronavirus pandemic as a vehicle to defeat Trump, the elected members of the Democrat party exposed themselves as petty and vindictive tyrants. They calculatingly curtailed individual freedoms, initiated unnecessary and devastating lockdowns, provoked unwarranted fear among the populace, destroyed the credibility of the government-based medical and science community, and brought the nation to the brink of economic chaos.
  4. The Democrat party in their pursuit of Trump has been self-exposed to be a wholly-owned subsidiary of the radical American Left which flagrantly utilizes Nazi tactics to achieve their goals.
  5. The ruling elite/left cabal, determined to defeat Trump in 2020, pulled out all the stops including election fraud to accomplish their goal. As a result, there should no longer be speculation about election fraud on a grand scale. It exists. Further, this same cabal is now audaciously attempting to embed potential election fraud in every state and make certain someone unacceptable to them is never elected president.
  6. What was once referred to as the “mainstream media” can no longer claim to be impartial as they marched in lockstep denigrating Trump and vilifying his voters. They are the unabashed propaganda arm of the ruling elite/American left oligarchy, willingly disseminating “fake news” about the opposition and regurgitating the talking points given to them by their masters.
  7. The elites have acquiesced to their bedfellows, the left, accelerating their schedule for achieving political hegemony by willfully fomenting civil unrest. The main weapons in this scheme are the accusation of “systemic racism” and the advocacy of Critical Race Theory that mandates overt racial discrimination, the turning of a blind eye to virulent and growing anti-Semitism, and confrontational censorship of “misinformation” and “unacceptable beliefs” by utilizing social media, corporate and governmental extortion.
Over the past four months, the media has extensively trumpeted the autocratic policies of the Biden Administration and a Democrat-controlled Congress. -- policies which encompass and further expose all the above. Thus, the bulk of the citizenry cannot honestly claim to be ignorant or unaware of what is happening in the country as it should be evident to anyone with a modicum of awareness and intelligence not drowning in mindless fealty to the Democrat party or Marxist ideology.

Language is the primary mechanism of communication. If the words that comprise our language lose meaning, it will become impossible for us to understand each other. We will become, and are becoming, inherently less connected and more divided.

Perhaps more concerning is what the American regime is currently doing to the Capitol trespassers. The regime’s actions are without question more evil and immoral than the act of trespassing at the Capitol itself.

Federal prosecutors and judges are holding mostly first-time offenders without bond in a segregated section of a D.C. jail. The vast majority of detainees have been charged with misdemeanors, not felonies. The Justice Department has yet to charge any of the people they arrested after January 6 with “insurrection” or “terrorism,” let alone “treason” or “sedition.” They are being denied due process.

Worse, the FBI and the Defense Department are turning the surveillance powers we generously granted them after 9/11 inward, and using them against anyone who might be considered subversive to the official narrative. The regime is quietly using January 6 as a pretext to launch a new “War on Terror” against any American citizen who doesn’t obey.

We are entering a period of political persecution unlike anything we’ve seen in American history, all premised on the lie that “fascist, white supremacist, terrorist insurrectionists” attempted a “coup” on January 6—a lie constructed using words that no longer have an agreed-upon meaning.

It can only end badly.

The biggest problem for Democrats is they cheated to win in 2020 by getting states to violate their own election laws to make it easier to stuff the ballot box with mail-in votes.

If Democrats do not codify those mid-election rule changes, Biden could be their last president.

Atlantic reported, "Anxiety is growing among a broad range of civil-rights, democracy-reform, and liberal groups over whether Democrats are responding with enough urgency to the accelerating Republican efforts to both suppress voting and potentially overturn future Democratic election victories."

Democrats want "to pass the national election standards," which means federalizing all election, which means having the federal bureaucracy decide who wins what election. Look for demands for diversity and equity to ensure Democrat victories. Poca Town Hall could look like a Harvard faculty meeting.

But Republicans have the votes to stop them in the Senate.

For example in Maricopa County, 11% of ballots went to adjudication. And the adjudication records were deleted (and then, recovered). Also follow the time travelling ballots. One time is an error, two times is two errors, multiple times is knavery.

He's in his 70s. He's rich. Why bother running for office again when he can enjoy his money? Would he like the kingmaker role? If Trump decides to run again, the primaries are over. If he doesn't, he needs to pick a successor, and right now, that looks like Florida Gov. Ron DeSantis. The only question is whether the base will follow? We all see what happens when Trump isn't on the ballot. Turnout dips, but DeSantis is popular with more establishment types as well. Political coalitions are often non-transferable. Will Trump be an exception to the rule if he gets behind DeSantis quickly? We shall see.

Extinction is Forever . . .

Except when it isn't, UPI, Scientists confirm discovery of giant tortoise believed extinct since 1906

A giant tortoise believed to have gone extinct more than 100 years ago has been found in the Galapagos Islands, and researchers are now preparing an expedition to see if more can be found.

Scientists from the California Academy of Sciences said the lone female turtle, identified with the chelonoidis phantasticus species, was found in 2019 on Fernandina Island during a joint expedition of the Galapagos National Park and the Galapagos Conservancy.

Yale University researcher Gisella Caccone and a team of geneticists performed an analysis on the tortoise and compared it with the last known specimen taken in 1906 for confirmation, according to the Galapagos National Park Facebook page.

"Rediscovery of this lost species may have happened just in time to save it," tortoise expert James Gibbs, vice president of science and conservation with the Galapagos Conservancy, said in a statement. "Now we urgently need to complete the search to find other turtles."

It would be nice if the could find a male on the island (as far as I know, the Galapagos Tortoise species are mostly endemic to a particular island (I think Darwin wrote a book about that). But if not, a hybrid, preserving half the genes could be an alternative. And I know just the turtles to do it:  COWABUNGA! Diego the horny tortoise

A 100-year-old giant tortoise named Diego and from the Galapagos' Española Island is retiring from controlled baby-making after he helped saved his entire species from extinction by fathering 800 children, reports The New York Times. Nearly eight decades after he was taken from his native habitat, Diego will finally return home to Española Island in March.

While Diego was one of several turtles participating in a breeding program at the Fausto Llerena Tortoise Center on the island of Santa Cruz, he "displayed an exceptional sex drive," according to the article. He joined the program in 1976 after living at the San Diego Zoo for 30 years. With his coital help, the Tortoise Center amazingly increased its shelled population from 15 to 2,000. Forty percent of those offspring were sired by — you guessed it — Diego himself. If you can believe it, though, he wasn't even the most feisty member of the bunch.

“Another more reserved, less charismatic male" produced 60% of the kids, according to James P. Gibbs, a professor of environmental and forest biology at the State University of New York in Syracuse, per the Times. A third male had virtually no progeny.

“It clearly is the other quieter male that has had much more success,” said Gibbs, according to the article. “Maybe he prefers to mate more at night."

Maryland, My Maryland

Maryland Governor Vetoes Bill Making Maryland a Sanctuary State

Maryland Gov. Larry Hogan announced Wednesday that he has vetoed a bill that would make Maryland a sanctuary state.

“As promised, I have vetoed sanctuary state legislation that would hinder local law enforcement’s ability to cooperate with federal law enforcement,” Hogan tweeted. He also asked for people to sign a petition telling the state legislature to uphold his veto.

“Local law enforcement should fully cooperate with federal law enforcement—a principle I have consistently upheld throughout three federal administrations led by presidents from both political parties. Flawed legislation such as this sets a dangerous precedent regarding the state’s commitment to upholding the law and ensuring the safety of our citizens,” Hogan said in the petition.

Hogan is not much of a Republican; how can he be in a state so dominated by Democrats. But he's likely better than the alternative.

Of course, his having to veto it means our legislature voted in favor. Our own delegate, Mark Fisher, a Republican, voted against it. It looks like a override vote in the MD could be close, the original vote was 86 - 44, with several missing or abstentions. 


Election 2020: The "Truth" is Out There

The media push is on for the Jan. 6 "Truth" Commission, which, being a Democrat congressional effort, will be about anything but the truth. WaPoo whines Sicknick’s family and the police officers who protected lawmakers Jan. 6 plead with GOP senators to back investigation. Sicknick did pretty good out of this, by getting a state funeral, lying in the Rotunda, out of an ordinary stroke.  Are they going to take that back, when the "Truth" officially shows his death was unrelated? CNN reports Romney says Republicans blocking January 6 commission 'would be seen as not wanting to let the truth come out' . Truth or "Truth?" At PM, Senator Collins signals she's in favor of January 6th bill but demands changes. WapPoo is counting, Where Republican senators stand on voting for a Jan. 6 commission, 3 support, 9 still considering, 28 oppose, and 10 won't answer the Poo. According to AllahPundit at Hot Hair, CNN reports McConnell asking GOP senators to tank the January 6 commission as a "personal favor" but he's not sure he believes them. But I hope so. At least McConnel is clear eyed about what the Democrats are trying to do.

Either way, =Politico is reporting that he’s now locked down the votes he needs to guarantee that the commission is filibustered. Red-state Dem Jon Tester is irate. “We’ve got to get to the bottom of this sh*t,” he told Politico. “Jesus. It’s a nonpartisan investigation of what happened. And if it’s because they’re afraid of Trump then they need to get out of office. It’s bullsh*t. You make tough decisions in this office or you shouldn’t be here.” Even so, Manchin reiterated again today that he won’t nuke the filibuster to get the commission through . . .

The move has been widely seen as a rebuke to Secretary of State Katie Hobbs, who has been vocally critical of the continuing audit of Maricopa County's 2020 election results.
