Maryland, My Maryland

Rep. David Trone’s (D-MD) PG
County Executive Angela Alsobrooks
At the Free Bacon, David Trone's Financial Disclosures Don't Add Up. Experts Say That Could Land Him in Legal Trouble.

It’s unclear how much Rep. David Trone’s stake in Indiana Fine Wine & Spirits is worth, but it’s enough that the Maryland Democrat pledged it as collateral for a loan worth up to $25 million in August 2020.

But you wouldn’t know that from Trone’s financial disclosures. In both 2020 and 2022, Trone didn’t even mention the Indiana wine franchise—an extension of his Total Wine empire he launched with his brother in 2019—omissions that imply his stake in the business those years was worth $0.

For more than a decade, the Maryland Democrat has pledged at least 20 offshoots of his $2.4 billion Total Wine empire as collateral for the loan, which PNC Bank first disbursed in 2008. But a Washington Free Beacon review found that for years after launching his first campaign for Congress in 2016 and winning his first term in 2018, Trone didn’t disclose his ownership in at least eight of those offshoots in his financial disclosures to the public.

Experts say Trone’s apparent failure to disclose all his assets could land the Democrat in legal trouble.

"Our democracy depends on the trust of the people in our elected officials," said Tom Anderson, the president of Last Government Watchdog. "Congressman Trone appears to have violated that trust."

By "failing to take seriously the disclosure of all assets and liabilities," Trone is "opening the door to serious penalties of up to five years in prison and/or up to a $50,000 fine if he is found to be criminally avoiding disclosure," Anderson told the Free Beacon.

Trone, the favorite to challenge former Maryland Gov. Larry Hogan (R.) for Maryland’s open Senate seat in November, has made no secret of his wealth. The congressman signaled he would be willing to spend $50 million of his own money on his Senate campaign before entering the race in May 2023 and has since spent a record-breaking $41 million leading up to the primary.

In a primary debate on Apr. 19, Trone boasted that he was "the largest donor to Democrats in the last three cycles," and that his donations help "drive our Democratic Party. Not only in the House but also in the Senate."

Trone has Total Wine to thank for providing him with the revenue necessary to finance his political career. He’s raked in at least $120 million in distributions from Total Wine since 2018, and in 2022 he reported owning interest in 21 of the chain’s affiliates with a combined stake of no more than $80 million.

Taking Trone’s disclosures at face value, it appears he has already poured a significant chunk of his net worth into his Senate campaign. But the figures in Trone’s financial disclosures pale in comparison to Total Wine’s $2.4 billion valuation as estimated by the Bloomberg Billionaires Index. The liquor behemoth is exclusively owned by the Trone family, with at least 71 state and local affiliates, each of which operate anywhere from one to several dozen storefronts. The company raked in $5.5 billion in revenue in 2022, doubling its haul from 2017.

I'm sure if he's done anything wrong, the Biden administration's DOJ will be right on it. /sarc

I will say this; he's pouring a ton of money into TV ads currently.

Beach Report 5/7/24

I got a late start today, and even tried waiting out a thunderstorm that never arrived, so I got down to the beach around 4 PM. A pretty nice day, partly cloudy, a few showers, and nearly 70 F.
The rain stayed away while I walked, though I did hear one ominous crack of thunder.
Could it be any more obvious?
A decent Lemon Shark tooth
Another easy one, a nice clean Physogaleus contortus, an extinct shark thought to be related to Tiger Sharks. All in all, 17 teeth, a couple of crab claws and a piece of stingray barb. Not too bad.

A Sparrow's Fall

Saltmarsh Sparrow
At the Virginia Mercury, ‘Frisky little songbird’ needs protection from sea level rise, environmental group tells feds. "Center for Biological Diversity petitions to put saltmarsh sparrow on Endangered Species list."

An environmental organization is asking the federal government to list the saltmarsh sparrow, a bird living on wetlands on the east coast, including Virginia, for protection under the Endangered Species Act due to expected losses from sea level rise and human development.

The Center for Biological Diversity’s petition to the U.S. Fish and Wildlife Service says the saltmarsh sparrow population dwindled from 212,000 in 1998 to 60,000 in 2012. That number was expected to be 28,215 in 2020, according to projections from the 2012 survey.

“The fate of these frisky little songbirds is inextricably tied to our ability to protect the tidal marshes they call home,” Stephanie Kurose, deputy director of government affairs at the Center for Biological Diversity, said in a statement. “Saltmarsh sparrows are creeping dangerously close to extinction and could disappear within the next 50 years.”

The sparrows were abundant in Virginia in the early 1900s, according to the petition. There are two kinds — a northern and southern — with the southern, which has more striping on its back and a darker crown, breeding in Maryland and Virginia.

The birds reside primarily between Virginia and Maine with trips as far south as Florida for the winter. The birds feed on insects and build nests on higher wetlands away from taller structures like trees and buildings.

According to the petition, sea level rise is causing flood waters to consume wetlands and is preventing the accumulation of sediment for the sparrows to build their nests on. Human development in coastal areas further deprives wetlands of dirt buildup, as heat stress also stunts the growth of vegetation that can be used to protect the birds from predators.

“Between 2030 and 2060, a tipping point will be reached after which the spring tide will come too early and too high, essentially ensuring that saltmarsh sparrows, which exist nowhere else on Earth, will be entirely unable to reproduce and will slip into extinction,” the petition states.

Well, except for the fact that salt marshes will grow upward with sea level rise, if they are allowed to, and not starved of sediment, or burned to make them prettier.

Separate research from the Center for Conservation Biology found that the rising tides may also pose harsher winters for the sparrows’ wetland habitats, thereby pushing the birds more inland where more food may be available.

In order to be listed as a protected species under the Endangered Species Act, there must be a demonstration of at least one of five hardships: loss of habitat, overuse for commercial, science and research purposes; disease or predation; a lack of existing regulatory protections in place; or other natural or manmade factors affecting its continued existence.

Under the regulation component, the petition states there are no federal protections of the animal in place, and the only state protections are in Massachusetts and Maine. In Virginia, the Department of Conservation and Recreation does list the species as “rare” in its Natural Heritage Resources of Virginia document.

But just as important as protection of the species is ensuring their habitat remains intact, the petition adds.

Forget It Jake, It's Baltimore

Jazz Shaw at Hat Hair, Feds Plan to Ask to Seize Marilyn Mosby's Florida Condo

Democrats have been working overtime in New York in an effort to seize Donald Trump's commercial and private property, including his estate at Mar-a-Lago. Thus far those efforts have come up short, but they may have inadvertently given others some ideas that could come back to bite one of their own. In Baltimore, former State's Attorney Marilyn Mosby is facing sentencing on a variety of charges ranging from perjury to fraud, including the fraudulent use of pandemic relief funds to buy luxury real estate holdings in Florida. On Friday, federal prosecutors in the case filed a motion asking the court to allow them to seize one of Mosby's vacation condos there as partial payment for the fines she will be expected to pay. Oh, how the mighty have fallen. (Baltimore Sun)
Federal prosecutors filed notice Friday that they will ask to seize former Baltimore State’s Attorney Marilyn Mosby’s Florida vacation condo on the same day as her sentencing on perjury and mortgage fraud charges.

The government indicated early on in the case that it would seek forfeiture. Friday’s filing formalizes prosecutors’ request and sets up the possibility of a legal fight over the condo at Mosby’s May 23 sentencing.

The government intends to sell the condo, according to the motion, which Mosby bought in February 2021 for $476,000. If there are profits from the sale, Mosby would get back her $47,600 down payment, prosecutors wrote.
As we previously discussed, Mosby has publicly called on Joe Biden to issue her a pardon so she can avoid all of this trouble. Unfortunately for her, Biden appears to have more than enough problems on his own plate at the moment. Overriding a series of lawful convictions in a case of official corruption and fraud probably wouldn't do much for his already plummeting poll numbers. In past cases of officials being prosecuted and receiving stiff financial penalties, the debt has typically followed them around once they were released from prison. That was the case with Rod Blagojevich, one of four of the past ten Illinois governors who wound up going to jail. He was hit with some hefty fines, but the court didn't wind up taking his property.

Perhaps we'll be seeing more of this in the future, however. This happens more often than some might think. There are three types of asset forfeiture available to the courts. These are described as criminal forfeiture, civil judicial forfeiture, and administrative forfeiture. Mosby would be facing criminal forfeiture, while Donald Trump is being threatened with civil judicial forfeiture in the hush money case. The courts are able to either seize the title to your property or order banks and other financial institutions to place a hold on your financial assets so you are unable to access them.

I suppose an action like this could send a message to other public officials and would likely be seen as justice being served in Mosby's case. But it still doesn't address the more important, underlying question. How is it that we keep ending up with public officials who violate the trust of the voters and seek to line their own pockets illegally? This is particularly problematic in Baltimore, where a series of mayors and City Council members have wound up in handcuffs. We are currently only a couple of weeks away from the city's mayoral primary, which winds up being effectively the same as the general election. The latest polling shows that former Mayor Sheila Dixon is running neck-and-neck in her bid to return to office.

This is the same Sheila Dixon who was driven from office and only barely avoided prison time after being convicted of fraud, theft, and criminal misappropriation. (She was sentenced to four years probation in a sweetheart plea deal.) And now the voters of Baltimore appear to be poised to potentially put her back in office. There is the answer to the question above. We keep winding up with politicians going on trial for criminal activity because we keep electing the same pack of criminals over and over again. Who is really to blame here... the politicians or the voters?

It's too bad she was caught too early to get in on the Trump feeding frenzy. I'm sure she could have found an excuse to bring him to trial. Then she'd likely have been off limits to Federal prosecutors.

Hail To Thee My Alma Mater

Campus Reform reports Humboldt campus occupiers left 8,000 LBS of debris, university says "A spokeswoman from California State Polytechnic University, Humboldt told Campus Reform that the anti-Israel campus occupiers left 8,000 lbs in debris for workers to clean up."

A spokeswoman from California State Polytechnic University, Humboldt told Campus Reform that the anti-Israel campus occupiers left 8,000 lbs in debris for workers to clean up.

Protesters at Cal Poly Humboldt previously occupied a portion of campus and two buildings, naming one of the “intifada hall.”

Posts on social media show that the protesters have vandalized a building on campus with anti-Israel messaging. The university estimates damage to property is in the millions, according to a university.

”Blood on your hands,” one message inside a campus office states.
. . .
The spokeswoman said that 32 campus occupiers were arrested on early Tuesday morning, adding that 13 were students, 1 is a faculty member, and 18 were non-students.

While the university told Campus Reform that damage to campus is in the millions, the spokeswoman said that an exact cost will be released shortly.

Roz Rothstein, co-founder and CEO StandWithUs, an international nonpartisan education organization that supports Israel and fights antisemitism, told Campus Reform that Cal Poly Humboldt should have intervened much earlier.

”While we stand with Humboldt’s decision to enforce both state law and its own campus policies, it’s clear that earlier intervention with this ‘encampment’ could have averted much of this chaos,” said Rothstein. “It is important that administrators nationwide take note and commit to enforcing their own policies on an ongoing basis instead of waiting for things to escalate.”

I guess they had to do something since there's no longer a statue of William McKinley in the Arcata Town Square to march around and climb on.

Flotsam and Jetsam - Jack Smith Admits to Tampering Classified Documents

John Solomon at JTN writes of a Trump Whodunnit: Prosecutors admit key evidence in document case has been tampered with "Legal experts call revelation a “serious violation” as Jack Smith’s team admits it also misled court."

In a stunning admission, Special Counsel Jack Smith’s team is admitting that key evidence in former President Donald Trump’s classified documents criminal case was altered or manipulated since it was seized by the FBI, and that prosecutors misled the court about it for a period of time. . . .In a new filing Friday, Smith’s team said that the order of documents in some of the boxes of memos that were seized by the FBI from Trump’s Mar-a-Lago estate was altered or jumbled, leaving two different chronologies: one that was digitally scanned and another the physical order in the boxes.

Smith’s team in a footnote also conceded it had misled the court about the problem by previously declaring that the evidence had remained in the exact state it had been seized. “The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court,” the footnote said.

Leading Report@LeadingReport "BREAKING: Special Counsel Jack Smith’s team is admitting that the order of documents in some of the boxes of memos that were seized by the FBI from Trump’s Mar-a-Lago estate were altered or jumbled, which legal experts say could prove to be a serious problem for prosecutors and a violation of court rules to preserve evidence in the state it was seized." PM, Jack Smith admits that evidence in Trump’s classified documents Mar-a-Lago case was tampered with. “The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court.” Althouse cite Politico"Special counsel Jack Smith’s team acknowledged Friday that some evidence in the prosecution of former President Donald Trump for hoarding classified documents at his Florida home...". I don't know how big a problem this is for the prosecution. Certainly, chain of custody on evidence is very important, and this suggests the evidence was handled sloppily by the Smith team. In a worst case, Judge Cannon could thrown out the evidence as tainted. With the team staffed with anti-Trumper, there's a possibility that a "smoking gun" could have been inserted later. But I'm going to bet against it.

Oregon, My Oregon

From John Sexton at Hat Hair, Arsonist Attacks Portland Police Vehicles

When Portland police arrived at a department training facility to help with a fire on Thursday morning, they found at least 15 patrol vehicles burning.

The Portland Police Bureau is searching for a suspected arsonist who they believe set the cop cars on fire around 1:55 a.m. while the vehicles were parked in a fenced training area, the department said in a news release.
The PPB released several photos of the burned cars, including this one.
The investigation is underway but the arsonist was caught on video so there's no question what happened here. The question that does remain is who is responsible. Everyone seems to know the answer even if they aren't saying it outright. Portland anarchists have had quite a week. Wednesday, just prior to the arson, a group walked through the city breaking windows.
Fireworks were set off, windows were broken and property was spray-painted by a group of suspects marching through downtown Portland Wednesday, according to Portland Police Bureau...

Police said among the businesses damaged include banks, coffee shops, cell phone and electronic stores, retail clothing and accessories shops and property belonging to Portland State University.
As mentioned, there was also a lot of damage done to the library at Portland State University. Are all of these things connected? There's no proof of that so far but what we can say is that the same sort of masked anarchists who smash windows and start fires also may have been involved at PSU. The police released a list of everyone they arrested yesterday when they cleared out the campus library and very few of these people strike me as the usual undergrads.

Greater Idaho can't come soon enough.
