By traveling across state lines to incite the mob in Brooklyn Center, Minnesota, Maxine Waters has opened the door on her possible expulsion from Congress, as Andrea Widburg notes today. But she may have shot herself in her other foot when it comes to the lawsuit she and other Democrats have filed against former President Trump over the January 6 Capitol incursion. Jonathan Turley explains:
Waters insists that Trump telling his supporters to go to the Capitol to make their voice heard and "fight" for their votes was actual criminal incitement. Conversely, Waters was speaking after multiple nights of rioting and looting, telling protesters to stay on the streets and get even more confrontational.
Waters has now guaranteed that she could be called as a witness by Trump in his own defense against her own lawsuit.
Waters’ most recent words could well be cited in the ongoing litigation over the Jan. 6 riot on Capitol Hill. As I have previously discussed, the lawsuit by House members and the NAACP may prove a colossal mistake. It is one of a number of lawsuits, including one filed by Rep. Eric. Swalwell, D-Calif., that could ultimately vindicate Trump shortly before the next election.
While it is possible that members could find a trial judge to rule in their favor, these lawsuits should fail on appeal, if they get that far. Moreover, they would fail under a lower standard of proof than the "beyond a reasonable doubt" standard in criminal law. Such a result would eviscerate the claim that Trump was guilty of criminal incitement in his speech.
Regarding the Jan. 6 Capitol Incursion, WaPoo whines Trump’s grip on GOP looms as support falters for independent probe of Capitol riot. Independent should be in quotes. Of course GOP support declined once it became obvious Pelosi intended it as a partisan hit job:
Initial negotiations aimed at establishing an independent commission in the style of the panel that investigated the Sept. 11 attacks ran aground earlier this year after Republican leaders insisted that it scrutinize left-wing extremism — including the amorphous antifa movement that Trump and other conservatives have blamed for fomenting violence in D.C. and other cities — alongside the far-right and white nationalist groups suspected of having planned or encouraged the mayhem. Democrats resisted, accusing the GOP of trying to distract the public from the fact that extremist groups in the Republican base were responsible for the riot.

On January 6, 2021, hundreds of thousands of supporters of President Donald J. Trump came to Washington, DC to rally in support of the President.
Those hundreds of thousands who came to DC represented the 75-plus million Americans who voted to re-elect President Trump.
I was lucky enough to be handling the press that day for the organization who sponsored the rally – Women for America First. I stood just feet from the stage and watched as President Trump spoke to the patriotic Americans in attendance.
The event was entirely peaceful – not a single incident of violence – Hell, despite being crammed into the ellipse like sardines, people didn’t even push or shove as the crowd slowly exited after the President’s speech.
As the hundreds of thousands of patriotic and peaceful Americans left the Ellipse, a few miles away a couple hundred of idiots unlawfully entered the Capitol Building.
Despite the spin from the media and the left, this was not an “armed insurrection,” and the only individual killed that day was an unarmed female veteran who happened to be a Trump supporter – Ashli Babbitt.
To this day, we do not know which police officer shot and killed Ashli Babbitt, nor do we even know why the officer felt compelled to use deadly force.
What happened at the Capitol was dumb – but it wasn’t an armed insurrection – and it certainly had nothing to do with the rally the President spoke at earlier at the Ellipse. Neither the President nor the hundreds of thousands of peaceful Trump supporters bore any responsibility for the actions of a couple of hundred of idiots.

At least eight defendants charged in the Jan. 6 riot have identified themselves as a journalist or a documentary filmmaker, including three people arrested this month, according to an Associated Press review of court records in nearly 400 federal cases.
The insurrection led to the deaths of five people, including a police officer, and there were hundreds of injuries. Some rioters manhandled and menaced the reporters and photographers who are credentialed to cover Congress and were trying to cover the mayhem that day. A group of AP journalists had photographic equipment stolen and destroyed outside the building.
One defendant, Shawn Witzemann, told authorities he was inside the Capitol during the riot as part of his work in livestreaming video at protests and has since argued that he was there as a journalist. That explanation did not sway the FBI. The plumber from Farmington, New Mexico, is charged with joining in demonstrating in the Capitol while Congress was certifying Joe Biden’s electoral victory over Donald Trump.
“I seek truth. I speak to sources. I document. I provide commentary. It’s everything that a journalist is,” Witzemann told a New Mexico television station after his arrest April 6. He did not respond to a social media message and email from the AP.
Witzemann’s nightly news show is titled the “Armenian Council for Truth in Journalism” — satirically, his attorney says. On its YouTube page, which has just over 300 subscribers, the show says it “delivers irreverent and thought provoking commentary and analysis, on an eclectic range of subjects.”
But did he have his journolist membership card ready? They mention the interesting case of John Sullivan, the Antifa and BLM linked rioter who sold his footage to CNN and NBC for $35K each.
Another defendant, John Earle Sullivan, leads the protest organizing group “Insurgence USA” and identifies himself as an activist and journalist who films protests, the FBI said. Defense attorney Steven Kiersh challenged court-ordered restrictions on Sullivan’s use of the internet and social media.
Sullivan “is legitimately self-employed as a documentarian and it is oppressive to require that he not be allowed to continue his primary area of employment for an extended period of time,” Kiersh wrote in court papers, attaching receipts for work Sullivan has done for CNN and other news outlets.
Sullivan is accused of saying, “Let’s burn this (expletive) down,” after the mob breached a security barrier, entering the Capitol through a broken window and telling officers inside to back down.

Wenstrup said none of the GOP members there that day were ever called in as witnesses by the FBI and that they were shocked the FBI, under then-FBI Acting Director Andrew McCabe, concluded the case was an attacker seeking suicide by cop — even though the Department of Homeland Security and the Office of the Director of National Intelligence labeled it as a domestic violent extremism event.Well, they didn't see a lot, as they prudently kept their heads down until Hodgkinson was killed by the police. According to Portland police, organizers planned two separate marches on Friday night. Authorities described one of the actions as “a peaceful event” where the participants disbursed on their own without requiring police contact. Law enforcement, however, said the other group included several hundred people, some of whom vandalized retail stores such as Nordstrom, Verizon, and Nike. Looting was also reported, police said, adding “windows were also broken at the First Christian Church, a location known for their generosity in feeding over a thousand meals weekly to the homeless.”And the fires, don't forget the "mostly peaceful" fires.
In a sign of the backlash building against organized, woke left political power in the marketplace, information resources like InvestingAdviceWatchDog.com have emerged to guide spending and investing choices of conservative consumers ready to pivot away from financially supporting businesses that the site says are "choosing to alienate half of the country by taking sides against Donald Trump, against Republicans, by attacking voting integrity laws, by pushing for censorship of conservative speech, and/or by reinforcing the Democrats' toxic culture war."
